Considerations The planned unit development plan is not a subdivision plat, it will be necessary to subdivide the property and comply with subdivision regulations. Right-of-ways, easement for trails, 4% dedication, drainage and other engineering requirements will be considered at time of subdivision. Common areas of PUD should be remained open and not used for swimming pools and used only for open space and ply lots for the benefit of the subdivision. A landscaping plan should be submitted showing areas where the natural vegetation will not be disturbed and detail landscaping along salvation ditch which will screen the development from the highway is to be evaluated by Planning and Zoning for the final development plan. Roads shall be shown to remain private. Home Owners Association to be formed for maintenance of roads and open spaces. The City will have to resolve the issue of water plant investment fees before annexation. There is to be a Homeowner's Association formed to maintain and care for common areas and rights of way. 2. Aeue Park will remain a private cul-de-sac, although improved to allow for proper fire protection. Access easements will be drawn for the Alpine Lodge and the Ferguson property. This condition, as now stated, meets with the approval of the City Engineer. 3. Duplex sites will be excluded and only single family dwellings allowed. 4. Soil analysis will be required on sites 5, 6, and 7 before building permits are issued. However., it is the opinion of Gerard H. Pesman, a licensed civil engineer, that the soils on sites 5, 6, and 7 are suitable for building. 5. A pedestrian right of way has been included along the Salvation Ditch and along McSkimming Drive. It is my hope that, the preceding conditions having now been met, the Plan- ning and Zoning Commission will reaffirm its recommendation for annexation of the Woerndle Subdivision to the City of Aspen. My commission expires: (SEAL) No ary Public PEN C I'I'Y OF aspen ,colorado, box v April 16, 1974 MEMORANDUM TO: CITY COUNCIL FROM: SANDRA STULLER SUBJECT: WOERNDLE PETITION FOR ANNEXATION Included on the agenda for Monday is consideration of the enclosed Petition to Annex approximately 312 acres owned by the Woerndles and situate in the Riverside Addition (north of Highway 82). The history of this request is rather complicated and a summary, we think, is appropriate. History of the Project The Woerndles' had made application to the county for sub- division approval in November 9, 1972. The county recommended the applicants seek annexation to the city because the tract abuts the city line. In December of 1972 the City P & Z viewed a proposed subdivision and PUD development for the Commission's conceptual approval (all formal action, of course, being condi- tioned on annexation). The P & Z moved that the city council consider annexation, and that conceptual approval be conditioned on (1) creation of a home owners association, (2) only single family houses being permitted, (3) soil tests being made on sites 5, 6 and 7, (4) a pedestrian right of way being included along the Salvation Ditch and McSkimming Drive and (5) that Aene Park be dedicated to the public. The city was advised by the applicant's letter dated June 19, 1973, that all requirements had been satisfied and the P & Z agreed. In June, 1973, the Woerndles' began a preliminary plat submission (in conjunction with a submitted annexation petition). At this time the city engineer determined that deficiences in the Aspen water system precluded effective fire protection for any additional development in this area. The Woerndle petition Memo to City Council April 16, 1974 Page 2 for annexation consequently, was removed from the June 25th council agenda. The plat consideration was tabled by the P & Z pending (1) annexation and (2) resolution of the water service problem. Six different plats have been submitted to the P & Z. The last is that one presented to you which generally satisfies the planning office (except that a 4% cash dedication would be requested in lieu of the strip along Highway 82). The area would be zoned R-15. Finally, the city engineer feels, with the comple- tion of the Marolt pipeline, water service can be accomplished by autumn of 1974. Annexation Procedure For the newer members of the council, let me outline the annexation procedures. Although there have been constant attempts to change the Colorado annexation procedures, the Municipal Annexation Act of 1965 is still in effect. The Act requires that not less than 1/6 of the perimeter of the area proposed to be annexed be contiguous with the annexing community (con- tiguity is not affective by the existence of a street between the tract to be annexed and the annexing municipality). The council must determine that: I. a community of interest exists between the tract to be annexed and the annexing municipality; 2. the tract to be annexed is urban or will be urbanized in the near future; and 3. the tract to be annexed is integrated or is capable of being integrated with the annexing community. There are limitations on annexation (e.g. annexing so as to bisect a parcel under one ownership, etc.) none of which are relevant here. Annexation is initiated by private landowners by submission of a petition. If the petition is signed by owners of one hundred per cent of the property proposed to be annexed (the case here) the city council may by ordinance annex without notice or hearing (other than that required by our ordinance procedures) and without election, unless the city council intends to impose conditions other than stated in the petition. Memo to City Council April 16, 1974 Page 3 If an annexation will affect an existing school district, annexation cannot occur without a resolution of the board of directors of the school district to which such territory will be attached approving the annexation. Territory annexed to a municipality is annexed as of the effective date of the ordinance, except for tax purposes (effective for tax purposes on January 1 of the following year). The statutes require filing of the record of proceedings with various entities, including by a recent amendment, with the Colorado Division of Local Government of the Department of Local Affairs. A municipality may initiate rezoning proceedings to rezone a tract after a petition has been submitted, but the rezoning shall not be effective prior to the final reading of the annex- ation ordinance. It is my understanding that the county has recently rezoned the tract R-15, but the statute seems to require the city to initiate rezoning procedures itself, without regard to existing zoning. In any event, any area annexed must be brought under our zoning code and map within 90 days of the effective date of the annexation ordinance. Pending rezoning, the city may deny issuance of building permits during such 90 day period. Finally, the applicant may commence subdivision pro- cedures after the petition is found to be valid, but final sub- division approval shall not be given until the effective date of the annexation ordinance. Council Action If the council wishes to consider the annexation, three actions are required on Monday: 1. a determination by the council that the above three conditions exist, 2. a determination that the petition satisfies the statutory requirements as to content and form; and 3. a motion to accept the petition. We will then draft an appropriate ordinance for consideration at the next meeting. June 10, 1974 WOERNDLE PUD - OUTLINE DEVELOPMENT PLAN Written Report to City Council The Planning and Zoning Commission has recommended the Woerndle PUD Outline Development Plan for approval by the City Council. Reasons for approval are as follows: 1. The application is consistent R-15 mandatory PUD in the County. 2. The development is restricted to single family dwellings and is less dense than R-15 in the city which permits duplexes on 15,000 square feet. 3. The cluster plan provides for open space areas that will retain natural aspen grove cover. By varying set back and lot area requirements for each building the plan takes advantage of 5 common areas and permits larger areas of contiguous open space. 4. Undersized private roads were designed in order to preserve as much as possible the natural terrain of the site. Their maintenance will be the responsi- bility of a home owners association. 5. Utilities will be placed underground. 6. Access cuts have been reduced to two for seven building sites; four of these ,ill access on Mc Skimming Road rather than the highway. 7. The development is in harmony with the surrounding residential neighborhood. n page 2 Woerndle Outline Development Plan 8. A more desirable environment can be expected to result from the submitted plan than would be possible through strict application of other sections of the zoning resolution. When a development proposal was presented to the County, the County P & Z suggested to the developer that the site might properly be annexed to the city. It was decided that the city P & Z should review a proposal for the site prior to annexation. A preliminary subdivision plat and a. PUD outline development plan was approved in concept by the P & Z last summer. Approval was given, conditional on 1)annexation; 2) resolving a problem of water supply; 3) correcting minor subdivision problems. The city engineer, on,the basis of the recent water service study, states that at least some of the project can be served by autumn, 1974. At this time the developer is requesting City Council consideration of an annexation petition. Summary The P & Z Commission has given conceptual approval of the proposed use of the land. The Economist finds no significant costs to the city would result from annexation, and that the PIF is sufficient to cover an extension of water service to the project. Landscaping of private sites should be restricted to natural aspen cover; additional planting along Highway 82, and to replace trees removed in construc- tion. Development schedule and all conditions should be included in a written agreement. Maximum building height should be determined. All approvals should be conditioned on subdivision approval.
