APPROVING AN APPLICATION FOR PARTIAL DEMOLITION OF
STRUCTURES INCLUDED IN THE INVENTORY OF HISTORIC SITES AND
STRUCTURES OF THE CITY OF ASPEN
LOCATED AT 101 AND 105 EAST HALLAM STREET, ASPEN, COLORADO

WItEREAS, pursuant to Section 26.72.020(C) of the Aspen Municipal Code, the
applicants, Alan Bush and Donald Krumm, represented by Augie Reno of Gibson-Reno
Architects, have requested approval of a proposal for partial demolition of structures included in
the Inventory of Historic Sites and Structures of The City of Aspen (hereinafter the "Inventory")
on the properties located at I01 and 105 East Hallam Street; and
WlJ,_EREAS, all applications for partial demolition of any structure included in the
Inventory, or any structure within an "H" Historic Overlay district, must meet the four
Development Review Standards of Section 26.72.020(C) of the Aspen Land Use Code in order
for the Historic Preservation Commission (HI?C) to grant approval; and
WHEREAS, pursuant to Section 26.50.010 of the Aspen Land Use Code, all
applications for significant additions to residential structures in the City of Aspen must either
meet the Residential Design Standards of Section 26.58.040 of the Aspen Land Use Code or
obtain a waiver from those standards from a Commission with the authority to grant such a
waiver; and
WltEREAS, Mitchell Haas, in his staff reports dated May 13, 1998 and June 10, 1998,
recommended approval of: a) the requested partial demolition with conditions; b) the proposed
additions to the Inventoried structures at 101 and 105 East Hallam Street with conditions; and,
c) Variances to the provisions of Sections 26.58.040(F)(11) mad (12) of the Aspen Land Use
Code; and
WHEREAS, the HPC granted the applicant a waiver from the requirements of Sections
26.58.040(F)(1I) and (12) of the Aspen Land Use Code as they would apply to the west and
south elevations, respectively; and
WHEREAS, a public hearing, which was legally noticed, was held at a regular meeting
of the Historic Preservation Commission on May 13, 1998, and then continued to May 27, 1998
and again to June 10, 1998, at which time the Commission considered and approved the
application with conditions by a vote of four (4) to three (3).
NOW, THEREFORE, BE IT RESOLVED:
With regard to the proposed partial demolition of the structures at 101 and 105 East Hallam Street,
as represented on the submitted elevation drawings dated June 4, 1998, the FIPC hereby grants the
following:
1. Approval of the proposed shed remodel hs proposed for both the Bush side (including
conversion to a garage) and the Krumm side, provided: (i) all existing materials that are
salvageable are reused and these decisions shall be made by the assigned IqPC monitor, and (2)
the selection of roof materials must be approved by the assigned HPC monitor.
2. Approval to construct of a new basement as proposed, provided structural reports verifying the
ability of the historic structure to withstand the intended method of construction are provided
by the applicant, and the HPC approves the intended method of construction; and,
3. In the event that the existing building is to be lifted, the applicant shall be required to provide a
letter of credit in the amount of $30,000 prior to building permit issuance to ensure the safe
relocation of the structure back onto its new foundation. The letter of credit shall be released
after an authorized City of Aspen buildh~g inspector approves the fmal relocation work.
4. The applicant shall provide information as to the current appearance of the foundation. This
appearance from the outside must be retained or recreated when the building is set back in
place. The house shall be placed back on the new foundation, set at the exact elevation as
the house currently sits. The method of maintaining this appearance shall be subject to
review and approval by Community Development Department staff and the HPC monitor.
5. Approval of the proposed "bump-out" of the recessed portion of the west elevation and the
proposed double-hung window to the south of the currently recessed portion as proposed
provided the window trim design and materials be approved by the assigned HPC monitor
prior to installation.
6- The proposed door (leading to the basement) on the historic portion of the east elevation is
approved provided the bricks removed for the placement of the door are reused to fill the
opening left where the door is moved from.
7. All proposed windows on the non-historic portion (southerly end) of the west elevation are
approved as proposed provided the window trim design and materials be reviewed and
approved by the assigned HPC monitor prior to installation.
8. All changes to the south elevation are approved as proposed, including a variance from the
"Volume" provision of the Residential Design Standards.
9. Approval of a variance from the "Subgrade Areas" provision of the Residential Design
Standards as it relates to all lightwells on the west elevation based on a finding that such a
variance is clearly necessary for reasons of fairness related to unusual site specific
constraints.
10. Approval of the proposed second story and roof changes as finally proposed, subject to
review and approval of materials by the assigned HPC monitor.
11. A final set of complete plans depicting all approvals granted herein shall be submitted to the
Community Development Department for inclusion in the case file.
12. All material representations made by the applicant in this application and during public
hearings shall be adhered to and shall be considered conditions of approval, unless otherwise
amended by a decision-making body having the authority to do so..
