APPROVING A MINOR DEVELOPMENT REVIEW FOR THREE SITE
FEATURES - THE OBSERVATION DECK, THE LANDSCAPE WALLS, AND A
40 FOOT TALL FLAG POLE - FOR THE LEWIS AND POSADA RESIDENCE,
414 NORTH FIRST STREET, CITY OF ASPEN.

WHEREAS, the Community Development Department received an application
from Johnathan Lewis and Roberto Posada, owner and applicant, for three site features on
their property located at 414 North First Street; and,
WHEREAS, the subject features are the "observation deck," the ,'landscape
walls," and a forty foot tall "flagpole;" and,
WHEREAS, the Planning and Zoning Commission approved, pursuant to Section
26.68.060 Hallam Lake Bluff Review, the location and prox!mate dimensions of the
observation deck and landscape walls and, as a condition of said approval, deferred the
decision of appropriate materials for these elements to the Historic Preservation
Commission; and,
WHEREAS, the Community Development Director, pursuant to Section
26.72.010, determined that the forty foot tall flag pole would be more appropriately
reviewed by the Historic Preservation Commission as a Minor Development due to
possible effects on the historic resource; and,
WHEREAS, during a regular meeting on August 26, 1998, the Historic
Preservation Comm!ssion considered the three site features, pursuant to Section
26.72:010 Minor Development, and approved by a 8-0 vote the three site elements for the
Lewis/Posada residence with the conditions recommended by the Community
Development Department.
NOW, THEREFORE BE IT RESOLVED by the Historic Preservation Commission:
That the Minor Development Review for the Lewis/Posada Residence, 414 North First
Street, is approved with the following conditions:
1. The proposed metal tubing for the observation deck is hereby approved.
2. The landscape walls may be constructed with pre-cast concrete segments. Any
substantial change to the location or dimensions of these walls may require an
amendment to the Hallam Lake Bluff Review.
3. The flag pole is approved in its proposed location. It shall be wooden and shall not be
greater than 40 feet in height. No lighting of the flags is pcnnitted.
4. The applicant shall record this Historic Preservation Commission Resolution with the
Pitkin County Clerk and Recorder located in the Courthouse Plaza Building. There is a
per page recordation fee. In the alternative, the applicant may pay this fee to the City
Clerk who will record the resolution.
5. All material rppresentations made by the applicant in the application and during public
meetings with the Historic Preservation Commission shall be adhered to and
considered conditions of approval, unless otherwise amended by other conditions.
APPROVED by the Historic Preservation Commission at its regular meeting on August
26, 1998.
