HomeMy WebLinkAboutresolution.council.016-06 RESOLUTION NO. 16 (Series of 2005) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, POSTPONING THE ELECTION ON CITIZEN INITIATED ORDINANCES IN THE EVENT PROTESTS FiLED CHALLENGING THE SUFFICIENCY OF SIGNATURES ARE NOT RESOLVED PRIOR TO APRIL 11, 2005. WHEREAS, the City Council adopted Resolutions No. 7 and No. 8, Series of 2005, referring two citizen initiated ordinances, commonly known as the Citizen Annexation Ordinance and the Citizen Affordable Housing Ordinance, to the registered electors of the City of Aspen at the municipal election to be held on May 3, 2005; and WHEREAS, protests have been filed pursuant to Section 31-11-110, C.R.S., challenging the sufficiency of the signatures contained within the petitions for said proposed ordinances; and WHEREAS, Section 31-11-104, C.R.S. requires that the City Council refer to the registered electors of the City proposed ordinances initiated by its citizens only after a final determination of petition sufficiency; and WHEREAS, the protests filed in these matters challenge the sufficiency of the petitions for the Citizen Annexation Ordinance and the Citizen Affordable Housing Ordinance; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1. In the evem that the protests filed challenging the petition sufficiency of the Citizen Annexation Ordinance and the Citizen Affordable Housing Ordinance are not finally determined on or before April 11, 2005, at 5 pm, the City Clerk shall withdraw fi.om the ballot of the May 3, 2005, municipal election the ballot titles for said proposed ordinances and the referral of said proposed ordinances shall be continued to a date following final determination of sufficiency. INTRODUCED, READ AND ADOPTED by the City Council of the City of Aspen on the 14th day March, 2005. I, Kathryn S.
