Main Street- Conceptual Review, Partial Demolition, Residential Design Standards, Variances- Public Hearing DATE: April 22,1998 SUMMARY: This property is a designated historic landmark, and includes a historic house, built in 1894. The site is located within the Main Street Historic District. In 1995, HPC approved the expansion of this building for conversion to office use. The property has since been sold and the new owner wishes to maintain it as a residence. The proposal before HPC is to make a garage and bedroom addition at the rear of the house and to alter the front porch and add a porch and deck on the east side of the house. A setback variance of 2 feet is requested on the west sideyard and a rear yard setback variance of 10 feet is requested, both for the location ofthe proposed garage. Staff recommends that approval be granted for conceptual review, partial demolition, Residential Design Standards, and variances with conditions. APPLICANT: Melinda Goldrich, owner. LOCATION: 706 W. Main Street, Lot Q and the west 20 feet of Lot R, Block 18, City and Townsite of Aspen. ZONING: "O," Office, historic landmark, historic district. SIGNIFICANT DEVELOPMENT (CONCEPTUAL) PROJECT SUMMARY AND REVIEW PROCESS: All development in an "H," Historic Overlay District must meet all four Development Review Standards found in Section 26.72.010(D) ofthe Aspen Land Use Code in order for HPC to grant approval. 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and 1 Attachment A with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to five hundred (500) square feet or the allowed site coverage by up to five (5) percent, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units pursuant to Section 26.40.090(B)(2). Response: Staff has attached numerous maps and drawings which document the appearance of the house over time. The original cross gabled cottage is still intact, although it has been added onto to double its original size. The 1893 bird's eye view of Aspen implies that the house did not originally have a front porch. By 1904, a front porch ran across the width of the front of the house. There was also a porch on the east side of the building and a small porch on the back. Sometime after 1904, the porches were all removed. A small porch was built at the entry and additions were made on the east and to the rear of the old house. The applicant intends to retain all of this construction, and to add a garage and bedroom at the rear, turn the existing porch into an airlock entry, and build a wrap around porch across the front and around the east side of the house. In terms of the front of the house, staff finds that enclosing the existing porch with glass is not appropriate. HPC has typically not approved enclosing a front porch because it so dramatically changes what is meant to be an open, and often decorative feature of a house. Staff also does not support building a porch that wraps around the east side of the building since this is not authentic to the original appearance of the house. Staff would support removing the existing porch, which is not historic, and building a porch that extends across the front of the house, as evidenced in the 1904 Sanbome map. The porch would need to be built to the dimensions shown on that map. The posts should be relatively simple in character and be of an appropriate scale, to show that they are not original to the house but are sympathetic to its detailing. Prior to reconstruction of this element, a search should also be made by the applicant of the Aspen Historical Society's photo archives to see if any pictures of the house circa 1904 can be found. Although not a part of this proposal, staff would support the removal of the aluminum siding and restoration of the original wood siding. The shutters on the front of the house should also be removed if they are not original, which would be staff' s suspicion. 2 C Returning to the actions proposed by the applicant, in terms of the deck that is shown on the east side of the house, this may be acceptable as long as there is no roof over the deck and the deck extends no further towards Main Street than the double hung window on the east side of the original house, so that the front porch and side deck are independent elements. A door as proposed on the south side of the building to access the east deck is also acceptable, although a single door rather than french doors is more appropriate architecturally. Staff finds that the flagstone path proposed to run along the east side of the house does not impact the building. At the rear of the property, the applicant proposes a small expansion of the kitchen and a single stall garage plus storage. A bedroom is to be placed above the garage. Staff finds this aspect of the proposal in general to be sympathetic to the original house, and certainly less impactive than the commercial remodel that was approved for this property a few years ago, or the residential expansion brought in by the previous owner. The proposed addition has some characteristics that are similar to the larger carriage houses which were historically built along Aspen's alleys. The single stall door and second floor porch contribute to the character of the alley and the design character of the addition. Staff' s concern with the renovated appearance of the house that will result from this project has less to do with the proposed construction than with the character of the rear portion of the existing house, and how the extended roofline and easement windows on the east are more 1950's in character than sympathetic to the Victorian house. Although it is not suggested that the applicant make changes to existing construction, the architect may look at making the windows on the new addition more vertical in character than some of those shown, to be compatible with the original house rather than the newer addition. Along these same lines, staff supports the requested setback variances. It would not be desirable to have the west wall of the new garage in the same plane As the already long unbroken wall on the west side of the house, therefore an offset of the garage towards the west property line may be considered desirable. The variance needed is 2 feet. On the rear yard setback, the applicant proposes to provide 5 feet instead of the required 15 feet. The office zone district requires a 15 foot rear yard variance, presumably to accommodate parking behind commercial buildings. However this is a residential use, and just across the alley in the R-6 zone district the required rear yard setback to a house identical to this would be 5 feet for garage space and 10 feet for living space. This would mean that the location of the garage as proposed is appropriate, but the second floor living space would have to be pushed 5 feet towards the front of the house. Staff finds that it is most desirable for the preservation of the house to avoid encroachment of second floor space close to the original cabin, therefore a rear yard setback variance of 10 feet should be granted. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood ofthe parcel proposed for development. 3 7 Response: The surrounding neighborhood is zoned "O," Office. At this end of Main Street there are still numerous buildings in residential use, which staff finds contribute greatly to the entry to town. Keeping this house in residential use, as well as the adjacent house, 702 W. Main Street, is very positive for the historic district and for the character of the individual buildings. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. Response: Staff finds that the proposal does not detract from the historic significance of the property. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof. Response: Some direction has been offered in terms of actions that could be taken to improve the architectural integrity of the house, for instance removal of the aluminum siding and the shutters. Also, direction has been given as to how to restore the front porch and how to make minor alterations to the addition to be compatible with the historic architecture. PARTIAL DEMOLITION 1. Standard: The partial demolition is required for the renovation, restoration or rehabilitation of the structure, or the structure does not contribute to the historic significance of the parcel; and Response: Demolition is required at the rear of the existing building to make the new addition. The demolished area is not historic construction. 2. Standard: The applicant has mitigated, to the greatest extent possible: a. Impacts on the historic significance of the structure or structures located on the parcel by limiting demolition of original or significant features and additions. Response: No original features are to be removed. b. Impacts on the architectural character or integrity of the structure or structures located on the parcel by designing new additions so that they are compatible in mass and scale with the historic structure. Response: The issue of compatibility has been addressed above. 4 COMPLIANCE WITH THE RESIDENTIAL DESIGN STANDARDS Response: Staff finds that the proposed application is in compliance with the Residential Design Standards. ALTERNATIVES: The HPC may consider any ofthe following,altematives: • Approve the Development application as submitted. • Approve the Development application with conditions to be met prior to final review. • Table action to allow the applicant further time for restudy. (Specific recommendations should be offered). • Deny Development approval finding that the application does not meet the Development Review Standards. RECOMMENDATION: Staff recommends that approval be granted for conceptual review, partial demolition, Residential Design Standards, and variances with the following conditions: *~r64\ TA-*. @4-«14- 1,Jth=LA.. 1. Main Street- Conceptual and Final Review, Partial Demolition, Residential Design Standards- Public Hearing DATE: April 22, 1998 SUMMARY: This property is not individually designated as historic, but is located within the Main Street Historic District. A single family house and a caretaker unit exist on the site. Recently HPC granted approval for a front porch and picket fence to be added to the house and property. At this time, the owners' request approval to demolish an existing mechanical room/ laundry room and carpordgarage area, and to add a small basement for storage, new living space and a new carport. HPC looked at the project in a very general way at a worksession. The applicant then went before the Board of Adjustment to request variances that were needed for certain areas of the addition, which were approved. Please note that the applicant requests Conceptual and Final be combined into one review to accommodate his construction schedule. HPC has taken this action on some other cases in the past and may find it acceptable in this case if there are no areas for restudy with the proposal. Staff recommends that approval be granted for conceptual and final review, partial demolition, and the Residential Design Standards with the condition that the existing driveway cut off of Sixth Street be returned to grass. APPLICANT: Mark Pearson, owner. LOCATION: 702 W. Main Street, the east 10 feet of Lot R and all of Lot S, Block 18, City and Townsite of Aspen. ZONING: "0," Office, historic district. 1 Attachment A SIGNIFICANT DEVELOPMENT (CONCEPTUAL) PROJECT SUMMARY AND REVIEW PROCESS: All development in an "H," Historic Overlay District must meet all four Development Review Standards found in Section 26.72.010(D) ofthe Aspen Land Use Code in order for HPC to grant approval. 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to five hundred (500) square feet or the allowed site coverage by up to five (5) percent, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units pursuant to Section 26.40.090(B)(2). Response: The attached drawings thoroughly detail the areas of demolition and new construction. The house is not listed on the historic inventory, and its background is unknown. No buildings are shown on this property on the historic maps through 1904. A few years ago, the house was approved for demolition to be replaced by an office building. Subsequently, it was purchased and will remain a residence. As part of the application, living space and a carport and garage which currently link the house and accessory unit together will be removed. The carport will be relocated to be accessed off of the alley, and the driveway which currently enters off of Sixth Street is to be abandoned. Staffrecommends a condition of approval that this area be returned to grass. The new construction is in keeping with the materials and general form and design of the existing buildings. The height of the new addition is 20 feet, which is 5 feet lower than the maximum allowed. The small porch that is provided on the east side and the caretaker unit contribute to the street and are in character with elements that were typical of Victorian homes in Aspen. Staffhas no concerns withthe project and sees no areas where restudy is needed. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: The surrounding neighborhood is zoned "0," Office. At this end of Main Street there are still numerous buildings in residential use, which staff finds contribute greatly to 2 Ar the entry to town. Keeping this house in residential use, as well as the adjacent house, 706 W. Main Street, is very positive for the historic district and for the character of the ~ individual buildings. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. Response: Staff finds that the proposal does not detract from the historic significance of any adjacent property. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof. Response: The house is not considered historically important. PARTIAL DEMOLITION 1. Standard: The partial demolition is required for the renovation, restoration 0* rehabilitation of the structure, or the structure does not contribute to the historic significance of the parcel; and Response: Demolition is required at the rear of the existing building to make the new addition. The demolished area is not historic construction. 2. Standard: The applicant has mitigated, to the greatest extent possible: a. Impacts on the historic significance of the structure or structures located on the parce~ by limiting demolition of original or significant features and additions. Response: The structure does not have historic significance. b. Impacts on the architectural character or integrity of the structure or structures located on the parcel by designing new additions so that they are compatible in mass and scale with the historic structure. Response: The issue of compatibility has been addressed above. COMPLIANCE WITH THE RESIDENTIAL DESIGN STANDARDS Response: Staff finds that the proposed application is in compliance with the Residential Design Standards. 3 19 ALTERNATIVES: The HPC may consider any ofthe following alternatives: • Approve the Development application as submitted. • Approve the Development application with conditions to be met prior to final review. • Table action to allow the applicant further time for restudy. RECOMMENDATION: Staff recommends that approval be granted for 702 W. This amendment includes a reduction of three lodge units, lowering and moving two front units further back from the street, and slightly expanding the foot prints of these units by approximately 100 square feet to accommodate ADA requirements. Staff will present drawings during the hearing. The new plan requires amending the GMQS and conditional use approvals. Both of these reviews may be handled by the Community Development Director. Because the project is in the Main Street Historic Overlay and was originally reviewed by the HPC, the Commission has perview over any amendments. Staff verbally reviewed the proposed changes with the Project Monitors. Both Monitors believed the changes warranted consideration by the Commission for a more formal decision. To the extent HPC makes a finding, the Community Development Director may either approve, approve with conditions, or deny the proposed amendment. APPLICANT: L'Auberge Swiss Chalet. 535 West Main Street. Represented by Tracy Haysfield, owner, and David Gibson, Architect. BACKGROUND: The original approval for this project was granted in 1995 by City Council ordinance No. 25. The applicant was approved for an insubstantial amendment to break the project into two phases in June of 1997. STAFF COMMENTS: Initial staff response to the proposal is positive. The applicant's proposal reduces the impact of the structures on Main Street by lowering the roof lines and providing a more open feel to the sidewalk view. Each building is a dwelling unit. The applicant proposes to make an addition to the main house in the open space between the two structures. Conceptual approval of the application was granted on June 11, 1997, without conditions. The applicant attended HPC for final design approval on April 8, 1998, but was given some direction for restudy of the proposal. The revised design is attached as well as the proposal from April 8 in terms of the architecture of the new construction only. Staff recommends final approval be granted. The applicant has incorporated HPC's comments into the new design, improving its compatibility with the historic house and carriage house. APPLICANT: Don and Karen Ringsby, owners, represented by Gray Ringsby. LOCATION: 514 N. 3rd Street, Lots 1 and 2, Block 40 of the unrecorded Hallam's Addition to the City of Aspen. SIGNIFICANT DEVELOPMENT WINAL) PROJECT SUMMARY AND REVIEW PROCESS: All development in an "H," Historic Overlay District, or involving historic landmarks, must meet all four Development Review Standards found in Section 26.72.010(D) ofthe Aspen Land Use Code in order for HPC to grant approval. 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and 1 with development on adjacent parcels when the subject site is in a "H " Historic Overlay District or is adjacent to an Historic Landmark. Response: The applicant proposes to create additional living space for the historic house, as well as a new entry. The addition is one story and will infill the open area between the house and outbuilding. From historic maps of the property, it is apparent that the house maintains its original form, except for additions on the east side of the house and the enclosing of the porches. Similarly, the carriage house has had a lean-to addition made to the north and modifications of windows. The proposed addition, for the most part, attaches to the existing buildings in areas of more recent construction, therefore limiting demolition of the original structures. Also, the area of connection to the historic house is minimized by the creation of a "hyphen" element. Staff finds the addition to be a reasonable expansion of living space. The Parks Department has indicated that removal of two trees within the footprint of the addition is acceptable. The historic house is nicely preserved and is typically Victorian in the complex intersection of many roofplanes and use of ornamental detail. Because the porches have been enclosed, the house no longer has the feeling of openness along the street facades that it had originally. The outbuilding has also been retained and was modified in a contemporary manner for use as a guest house. Staff finds that the carriage house remodel is successful and not competitive with the historic resource, at least in part because the two buildings are detached. It was recommended at conceptual approval that if the two buildings are to be linked, that the linking element must be very simple in character. The applicant has successfully achieved that goal. At the April 8, 1998 HPC meeting, the applicant received direction to restudy the height of the dormer on the addition and to look at the entry doors and window in general to be more compatible with the existing structures. Staff finds that this direction has improved the project. The applicant has made the desired changes along the street-facing elevation. The large windows proposed on the private (east) side of the building still seem overscaled, but they may be acceptable since they are not visible to the public. Staff would recommend that the windows in the dormer on the east side not have mullions, since no other windows on the building are ofthat character. It must be noted that the glass in the gabled dormer which is to be placed over the door falls into the "no window zone" required in the Residential Design Standards, as do the large windows on the east side. Staff finds that the west windows do not create a scale issue and helps to distinguish the addition as new construction. The windows on the east are not visible to the public. A variance is recommended and described below. 2 50 In regard to the site plan, the gravel pull-in parking space, although entered from the alley and not from the street, is somewhat in conflict with a general desire to screen parking from the street, however it is a pre-existing condition which may be maintained. The applicant should refer to the Engineering Department for approval of the pavers within the City right- of-way. Because this is City owned property, where private improvements are not generally encouraged, the walkway may need to be just a straight line of pavers, rather than the "T" shape that is proposed. At conceptual, HPC approved a site coverage variance for the project and' waiver of the Residential Design Standard regarding windows on the carriage house. 2. Standard: The proposed development reflects and is consistent with the character ofthe neighborhood ofthe parcel proposed for development. Response: Staff finds the proposal in general to be a minimal change to accommodate the owner's needs. The project is still well below the maximum square footage allowed for the site (given that HPC waived the FAR penalty for the existing windows in the "no window zone" on the carriage house at conceptual) and is of a pedestrian scale which is much more sensitive to the historic character of the West End than has been the surrounding development. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. Response: No demolition of the original structures is proposed, therefore staff finds that this standard is met. Partial demolition approval was granted at the conceptual level to remove small areas of non-historic walls as necessary to join the addition to the existing structures. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof. Response: The proposal allows the historic house and carriage house to remain as distinct elements, therefore the integrity ofthe buildings is retained. COMPLIANCE WITH THE RESIDENTIAL DESIGN STANDARDS Response: As noted above, two areas of the new windows fall into the "no window zone" which disallows window openings in the area between 9 and 12 feet above a finished floor. On the west side of the house, the lower foot of the triangular window in the gable end falls into this zone. On the east side, the upper foot of the large windows falls into this zone. Staff recommends a variance be granted in each case, finding that no negative impact on the historic resource is created. 3 51 ALTERNATIVES: The HPC may consider any ofthe following alternatives: • Approve the Development application as submitted. • Approve the Development application with conditions to be met prior to issuance of a building permit. • Table action to allow the applicant further time for restudy. (Specific recommendations should be offered). • Deny Development approval finding that the application does not meet the Development Review Standards. RECOMMENDATION: Staff recommends that HPC grant final approval with the following conditions: 1. Remove the mullions in the dormer windows on the east side. 2. Engineering Department approval is needed for the pavers within the City right-of- way. 3. HPC has granted a site coverage variance as needed for the addition. 4. HPC has waived the volume standard/FAR penalty for the "pre-Ordinance #30" windows in the carriage house to prevent an FAR penalty from being applied retroactively. HPC also grants a variance from the volume standard for the windows proposed in the new addition, as described above. 5. HPC has granted partial demolition approval. 6. The materials chosen will be as represented in the final review application. 7. The applicant must obtain the necessary tree removal permits from the City Parks Department. RECOMMENDED MOTION: "I move to approve the significant development application for 514 N. Third Street with the conditions outlined in the staff memo of April 22,1998." 4 5-2_ . RECEIVED 514 North Third Street - Final Review for 4/22/98 APR 1 5 1998 ASPEN / PITKIN COMMUNITY DEVELOPMENT The H.P.C. had a few concerns over the design presented 4/8/98 for final review. The main concerns were the height ofthe new addition and the dormer on the west (front) elevation. In response the new design has been lowered 1'-5" at the main ridge so that it is lower now than the main building and the carriage house. The total height ofthe new addition from grade is now 19'-6" which is significantly lower than the 25'-0" which zoning allows. The applicant would not like to go any lower than this or the windows in the gabled ends facing north and south would lose their windows and therefore the light inside. The dormer on the west (front) elevation has been removed and replaced with a small gable element offset to the left side of the new mass and centered over the entry. This removal ofthe dormer on this side will reduce the appearance ofmass even furtherure than the height reduction. The new gable has the same pitch as the existing main house. The proportion was carefully chosen to appear as ifthe new gable could fit inside the scaled part ofthe existing gable. Instead oftrying to duplicate the fish scales of the existing the new gable will be a simple glass window which is modern but is not overpowering due to its small size. The new entry is not centered in the new mass because if it were it would not be visible from the street. Offset to the left side, the entrance will just be visible behind the large pine trees that will remain. Even ifthe pine trees were someday to be removed the entry offset to the left is ~ in harmony with the other two doors on the front elevation ofthe existing buildings which are also offset to the left. The entry door shall be a single custom made two panel door with glass and mullions in the top panel and solid below similar to the existing exterior doors. The new door will be 8' in height and have 3/4 length sidelights to both sides. The sidelights are a reference to the original main entry door with sidelight seen on the north elevation. They also reference the vertical glass panels on the carriage house. The pair of windows to the right of the entry doors have changed slightly. By pushing the closet ofthe interior over slightly it allowed the windows to also slide over and are not hiding behind a post any more. The windows were also pushed closer together to give them a lighter and more Victorian feel. The sill height was also raised slightly to be more in harmony with the existing windows of the main house. The east elevation has also changed. The lower roof height has improved this elevation by tightening up the proportions. The windows in the dormer gable have been changed from three to four within the same width. This creates a more Victorian look by having each window be taller than it is wide. The even number ofwindows also goes better with the pair ofhigh windows on the carriage house. MuUions have been added to those dormer windows as a reference to fixed Victorian windows which generally have mullions. Mullions have also been added to the French doors on this elevation to soften them and make reference to the existing doors which have mullions of some kind. The siding will match the existing because all ofthe additions over the years have matched the existing. To change the siding now would be a mistake. With the lowering ofthe new ~ addition it becomes almost invisible from the north and south elevations. We feel this new design is in harmony with the existing structures in scale, mass, fenestration, materials, and roofpitch.
