HomeMy WebLinkAboutordinance.council.016-75RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. /6 (Series of 1975) AN ORDINANCE REDISTRICTING THE CITY OF ASPEN; ESTABLISHING THREE (3) VOTING PRECINCTS WITHIN THE CITY; PROVIDING THAT NO PRECINCT CONTAIN MORE THAN 1,200 ELECTORS; .AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING I~[EDIATE ENACTMENT WHEREAS, the Aspen City Council has determined that for the convenience of electors of the City of Aspen, it is necessary to re-establish the voting precincts created by its Ordinance No. 5, Series of 1975, and WHEP~AS, the Aspen Home Rule Charter, Section 2.3 thereof, authorizes the re-establishment of precincts provided the same is done by ordinance effective more than forty-five (45) days before any election; and provided further that the Council also establish the maximum number of electors in each precinct and that each precinct be substantially equal in the number of electors, and W}tEREAS, Section 49-25-45(b) of the Colorado Municipal Election Code requires that all changes in precinct boundaries be reported by the City Clerk to the County Clerk, and that a corrected map be transmitted to the County Clerk as soon as possible after such changes have been effected, and WHEREAS, the pending 1975 Municipal Election scheduled for May 6, 1975, requires, if the redistricting herein ordered is to be effective for such election, that this ordinance be adopted as an emergency measure pursuant to Section 4.11 of the Aspen Charter. ~OW, ?HEREFORE, ~E IT ORDAINED BY THE CITY COUNCIL OF RECORD OF PROCEEDINGS 100 Leaves THE CITY OF ASPEN, COLORADO: Section 1 There are hereby established three (3) voting pre- cincts within the City of Aspen, Colorado, ~ich precincts are more particularly described as: Precinct No. 1: ~11 that portion of the City of Aspen lying northerly and easterly of the following described line: ~eginning at a point, said point being the intercept of the centerline of Mill Street and centerline of The Roaring Fork River; thence southerly and easterly along the centerline of The Roaring Fork River to a point of intersection with the centerline of Spring Street produced northerly; thence southerly along the Spring Street centerline northerly production and centerline to the inter- section with the centerline of Durant Avenue; thence westerly along the centerline of Durant Avenue 68.14 feet more or less to the centerline of a new Spring Street (40 foot right-of-way); thence southerly along the New Spring Street centerline to the southerly right~of-way line of Ute Avenue; thence northwesterly along the southerly right- of-way line of Ute Avenue produced to an -2- RECORD OF PROCEEDINGS 100 Leaves Precinct No. intersection with the Aspen Ski Corp. Chair Lift No. 4 (Little Nell Lift); thence southerly along the centerline of the Little Nell Chair No. 4 to the City of Aspen Boundary Line. 2: ~All that portion of the City of Aspen lying between the following des- cribed lines: Line 1: Beginning at a point, said point being the intercept of the center- line of Mill Street and centerline of the Roaring Fork River; thence southerly and easterly along the centerline of the Roaring Fork River to a point of inter- section with the centerline of Spring Street produced northerly; thence souther- ly along the Spring Street centerline northerly production and centerline to the intersection with the centerline of Durant Avenue; thence westerly along the centerline of Durant Avenue 68.14 feet more or less to the centerline of a new Spring Street (40 foot right-of-way); thence southerly along the New Spring Street centerline to the southerly right- of-way line of Ute Avenue; thence north- westerly along the southerly right-of-way line of Ute Avenue produced to an inter- section with the Aspen Ski Corp. Line 2: Beginning at a point, said point being the intercept of the center- line of First Street and the southerly boundary of the City of Aspen; thence northerly along the centerline of First Street to an intersection with the north- erly right-of~~ay line of Smuggler Street or production thereof; thence easterly along the northerly right-of-way line of the vacated Smuggler Street and production of said line to the City of Aspen boundary. Ail that portion of the City of Aspen lying westerly of the following described line: Beginning at a point, said point being the intercept of the centerline of First Street and the southerly boundary of the City of Aspen; thence northerly along the centerline of First Street to an inter- section with the northerly right-of-way line of Smuggler Street or production there- of; thence easterly along the northerly right-of-way line of the vacated Smuggler Street and production of said line to the City of Aspen boundary. ~o voting precinct shall be established providing for -4- RECORD OF PROCEEDINGS 100 Leaves more than One Thousand Two Hundred (1,200) voters in said precinct. Section 3 Whereas Section 2.3 of the Aspen Home Rule Charter requires that any redistricting within the City be effective more than forty-five (45) days before any election, and adoption of this ordinance pursuant to Section 4.10 of the Aspen Charter would preclude application of the redistricting effected herein at the General Municipal Election to be held May 6, 1975, it is hereby declared that an emergency exists and that this ordinance be adopted pursuant to Section 4.11 of the Aspen Charter, that the same be passed at two meetings of Council, take effect on final passage, and be published within ten (10) days after final passage or as soon thereafter as possible. Section 4 That the City Clerk be directed, on the effective date of this ordinance, to forward to the Clerk and Recorder of Pitkin County a n official map of the City of Aspen reflecting the changes in the precinct boundaries hereby effected. Section 5 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid pro- visions or applications, and to this end the provisions or applications of this ordinance are declared to be severable.
