ORDINANCE NO.
(Series of 1975)
AN ORDINANCE AMENDING THE UNIFORM BUILDING CODE, ADOPTED BY REFER-
ENCE BY ORDINANCE 9, SERIES OF 1974, WHICH AMENDMENT MODIFIES THE
REQUIREMENTS FOR ACCESS TO DINING AREAS BY ELIMINATING THE REQUIRE-
~4ENT THAT ACCESS ALWAYS BE BY RAMP OR ELEVATOR, AND PROVIDING THAT
ACCESS TO FLOORS IMMEDIATELY ABOVE AND BELOW GRADE MAY BE BY STAIRS
WHEREAS, the Uniform Building Code now requires that access
to dining areas above and below grade be by elevator and/or ramp
and the City Council wishes to provide that restaurants may pro-
vide access by stairs for restaurant areas immediately above and
below grade,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the Municipal Code of the City of Aspen, Colorado, is
hereby amended by the addition of a subsection to Section 7-141
which said subsection reads as follows:
"(n) Contrary provisions of the Uniform Building
Code notwithstanding, access to a restaurant or
dining area located on one floor above or one floor
below grade may be by stairs and the elevator and/or
ramp requirements of Table No. 33-A of said code
shall not be imposed."
Section 2
If any provision of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall
not affect other provisions or applications of the ordinance which
can be given effect without the invalid provisions or applications,

and to this end the provisions or applications of this ordinance
are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on the
day of , 1975, at 5 P.M. in the City Council Chambers,
Aspen City Hall, Aspen, Colorado.
