AN ORDINANCE AMENDING THE UNIFORM BUILDING CODE, ADOPTED BY
REFERENCE BY ORDINANCE 9, SERIES OF 1974, WHICH AMENDMENT
MODIFIES THE REQUIREMENTS FOR INSTALLATION OF ELEVATORS AND
PEDESTIRAN RAMPS AND PERMITS EXEMPTION FROM SUCH REQUIRE-
MENTS BY THE BOARD OF EXAMINERS AND APPEALS ON REVIEW OF AN
APPLICATION FOR EXEMPTION ALL AS MORE SPECIFICALLY PROVIDED
HEREIN
WHEREAS, the Uniform Building Code requires the install-
ation of elevators and pedestiran ramps in the construction of
new buildings with commercial and other uses, and
WHEREAS, the Aspen City Council, on recommendation of the
Board of Appeals and Examiners, wishes to modify these pro-
visions to the extent of permitting exemption from the require-
ment when the public need for the same is limited and public
safety is otherwise assured,
~OW, THEREFORE, DE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That the Municipal Code of the City of Aspen, Colorado,
is hereby amended by the addition of a subsection to Section 1-141
which said subsection reads as follows:
"(n) Contrary to the provisions of the Uniform
Building Code notwithstanding, the Board of
Examiners and Appeals may review applic-
ation for exemption from the requirement
of supplying elevator or ramp access or
egress for any structure within the City
of Aspen and may exempt such applicant
when it shall appear installation of the

same is not necessary for the public health,
safety and welfare taking into consideration:
1. the number of stories in the proposed
structure which will be serviced only by
stairs, if the exemption is granted;
2. the type of uses in the proposed building
in terms of whether they are voluntary
uses (for example: restaurants, boutiques,
et cetera) or mandatory (e.~. service
uses, doctors', lawyers', dentists' and
other professional offices);
3. the members of~e .public which are expect-
~d to be serviced by the proposed uses in
terms of age and physical limitations;
whether there exist alternate commercial
and service facilities at grade level in
the area;
whether the applicant will incorporate
adequate fire safety features in the
proposed building;
whether there is sufficient means of
egress and ingress in the proposed build-
ing; and
whether there are proposed substitutes to
elevator and ramp access and egress so as
to accommodate as well as reasonably
possible the needs of the aged and
handicapped."

Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, ~uch invalid-
ity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provisions
or applications, and to this end the provisions or applications of
this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on the
__ day of , 1975 at 5 P.M. in the City Council
Chambers, Aspen City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED published as provided by law by
the City Council of the City of Aspen, at its regular meeting
