Chairperson Bill Dinsmoor called the meeting to order at 8:30 a.m. Commissioners in
attendance were Stan Hajenga, Terry Butler, Don Sheeley and Shae' Singer. Mark
Goodman, Marc Breslin and John Starr were excused.
Stan asked when the lighting person from Rising Sun was. I would like to see the
contract with the lighting guy. No one is getting any service.
Don said Takah Sushi seems to be out too far. It forces you into the middle of the mall.
Staff said they would look into the situation. Don also mentioned that Lush has a strange
offensive odor and do we have an ordinance that regulates those issues.
Don inquired about the S curve demonstration and if there was a report. Staff relayed
that it was successful and there will be another one the end of July.
Shea said Paul Sparks called and wants to have two dahlia's planted in the mall or
somewhere in the city. They would have to be maintained.
Bill said Kinder Morgan will be fixing the gas lines all summer long and he is concerned
about the loss of parking. Kinder Morgan send notices out and published in both papers
the schedules of what is coming down the road.
Sustainable Settings
Cavanangh O'Leary pointed out that the market has no produce from the Roaring Fork
Valley. We recently had Wildwood School and country day visit. We educate on all of
those levels. We grow and ranch lamb, eggs, broccoli, spineach, greens and potatoes.
Peter Forte said they offered a counter offer if they would be certified organic they would
be in the market but beyond organic is not acceptable.
Cavanaugh said they do not label their food organic.
Terry said change your name to not indicate that it is organic. Are you married to that
name? Do not advertise as organic and you can get in the market.
Mr. Levine said they were rejected in the Carbondale's farmers market because of
beyond organic.
Peter said the City Attorney said we have no legal basic to reject someone.
Cavanaugh said the contract breaks out the booths and we want under the CCLC booths.
Stan said there are too many issues regarding organic and non-organic and advertising. If
you want to do an educational booth it could be under CCLC.
Andrew Kole said if you do education under the non-profits maybe you could sell one
product every week as part of the fund-raiser and that way you wouldn't be competing
every week. That would get you in. Non-profit for fund raising.
Mr. Levine said it has to be economically viable and we would not do one product each
week. He said he would give up organic and go with home grown food.
Peter said we would love to have a compromise.
O'Leary said it is very expensive to be totally organic. We can give up the name.
Mr. Levine said the meaning for organic has changed. The slow food movement is
important in Aspen.
Terry said there are 40 different terms for organic. If they stick and make it very clear
what they are selling let them sell. In this case we are talked about a locally grown entity.
The Farmers market should be about Sustainable settings. It would be a shame to not let
them in. Terry said the term organic has been diluted. What means something, is that it
is locally grown.
Bill said my personal feeling are irrelevant. They went back to the farmers. I would not
recommend that we break those roles.
Shea said having tried to sell flowers through the farmers section it does often times feel
heavily weighted to the Grand Junction area. With them being a local grower it is
important. These people are in the valley and we have made exceptions.
Don said I am tom on this. On the other hand if they are talking to the attorney and
Mayor this is important to them.
MOTION: Shea made the motion that CCLC allow the booth; second by Terry.

Terry said what I see is that they have been treated unfairly and they kept trying and
overrode us, so what!
Allegheny pointed out that two people were not accepted and appealed to you all and you
tromped our process. I have seen the history happen. There were people with more
quality that were not accepted.
The farmer's contract is close to expiring and will be re-written. The loop holes will be
closed. The people closest to Aspen have that right to be here.

Allegheny pointed out that Carbondale was the potato era. There is something significant
to our valley having something local. Jennifer Craig had an incredible time getting into
the market but she is in. In my opinion there is an labeling issue and that is it.
Don said if the two parties can't come to a common ground then we have a problem.
Terry made the motion that with Peter's permission that we nominate Andrew Kole to be
the arbitrator get together again and come to a compromise that can perhaps pick out the
objectional things that they can be admitted to the market by the farmers group and that
we as the CCLC would like you to be included and Sustainable Settings needs to give
some too and not be stubborn; second by Shea. Motion died.
Bill said we should have the courage to make our own decisions.
Don said try to work it out.
Andrew said he would work with both parties.
Zocalito restaurant:
Andrew said the state says it has to be contiguous.
Elizabeth from CB paws said they have a sandwich board and if someone is walking they
see the tables and then cross over to the center part of the mall. Tourist don't want to
work too hard for things. It will cut out of the business.
Terry pointed out that 15 years ago the mall was full and we are trying to re-achieve this
again. Get some life in the mall. Long ago it was better than what is there now.
We know what it could be like.
Bill said the tables will slow people down and have people look for CB paws business.
Andrew suggested to cross promote in a positive way.
Staff said the owner called her and requested a tabling because she was in Denver.
The new owner of the Cooking school we have three sandwiches boards all over the
place which will block offthe alley. There is far too much clutter in the alley. It is more
of aesthetics that is needed.
One sandwich board that will promote all businesses in the alley.
MOTION: Don made the motion to approve the mall lease for Zocalito; second by Stan.
All in favor, motion carried.
Club Chelsea:
Greg Jurgenson, manager pointed out that they can't open until the real estate businesses
closes. We re going to talk with them and try to work something out.
MOTION: Don moved to approve the mall lease for Club Chelsea six feet out to the
length of their building; second by Terry. All in favor, motion carded.
Market:
Allegheny said we need to draw up by-laws that are clear and that are signed into law.
This year it was juried. We are an advisory group to the CCLC. We were privy to every
application that came in. There was a great improvement over last year. Next year we
will have even more applicants. Everything needs laid out clearly. There is nothing that
says Harmony Scott can't apply to go out on the mall.
The process shouldn't be opened after the process has been completed.. The farmers
function in a certain way. Allegheny also pointed out that he is not against competition.
The other thing that has been talked about is to have the artist commit for three years.
Could the contract be good for three years.
Stan said we discussed this and after the market is over we will revisit all the issues that
have caused problems. There are a lot of areas that need worked on.
Bill said we need to do some foundation building.
Don said we can do a worksession on it.
Terry said she has worked on the alleys, trash etc and one of the refreshing things about
being on the board is when they pass around the jewelry and she gets to judge it and see
the creativity.
Andrew said he talked to both groups and they have come to an agreement. They will
drop the beyond organic words. It would be an approval by CCLC subject to the farmers
approval.
MOTION Don made the motion that CCLC allow sustainable setting to be in the market
under the caviot that it is approved by the farmers; second by Stan. Motion carried 5-0.
