ORDINANCE NO. 66
(Series of 1975)
AN ORDINANCE AMENDING SECTION 24-3.7 OF THE ASPEN MUNICIPAL CODE
(A ZONING PROVISION) BY THE ADDITION OF SUBSECTION L THERETO
RECOGNIZING AS AN ACCESSORY USE WITHIN THE RESIDENTIAL DISTRICTS
THE KEEPING OF LIVESTOCK; PROVIDING THAT SUCH USE IS CLEARLY IN-
CIDENTAL TO THE USE OF THE PREMISES AS A RESIDENCE AND NOT USED
FOR cOMMERCIAL PURPOSES.
~EREAS, the City Council has determined that the
keeping of animals within the City of Aspen should be recognized
as a permitted use within residential districts if clearly in-
cidental and secondary to a use principally residential,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
?hat the Municipal Code of the City of Aspen, colorado,
is hereby amended by adding Subsection L to Section 24-3.7 which
said subsection reads as follows:
"L. In all residential districts there shall be
permitted the keeping of domestic animals
provided that the keeping of said animals
be normally incidental and subordinate to
the principal residential use of the pre-
mises, shall not change the basic character
thereof, shall not constitute a commercial
activity, and shall not violate any health,
sanitary or other regulations of the City
or State, or otherwise constitute a public
nuisance."
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such invalid-
ity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provisions
or applications, and to this end the provisions or applications of

this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on
/~ , 197~ at 5 P.M. in the City Council Chambers,
City Hall, Aspen, Colorado, providing that notice of the same
shall have once been given fifteen (15) days before such hearing
in a newspaper of general circulation within the City.

law by the City Council of the City of Aspen, at its regular meet-
