ORDINANCE NO. 9

AN ORDINANCE MAKING A SERIES OF AMENDMENTS TO THE PROVISIONS OF'
THE ASPEN MUNICIPAL CODE CONCERNING THE LICENSING AND IMPOUNDING
OF DOGS; ~4ENDING SECTIONS 5-28 and 5-31 TO INCREASE FROM $1.50
TO $2.90 THE CHARGE FOR ISSUING OR TRANSFERRING A DOG TAG; AMEND-
ING SECTION 5-45 TO INCREASE FROM $4.00 TO $5.00 THE CHARGE FOR
IMPOUNDING DOGS, ~ND, IN THE SAME SECTION, INCREASING FROM $4.00
PER DAY TO $5.00 PER DAY THE CHARGE FOR MAINTAINING IMPOUNDING
DOGS; .AND FURTHER AMENDING SECTION 5-45 TO REQUIRE THAT OWNERS
OF LICENSED DOGS BE NOTIFIED BY MAIL OF THE IMPOUNDMENT OF THEIR
DOGS; AMENDING SECTION 5-68(c) SO AS TO ESTABLISH A NEW PENALTY
ASSESSMENT FOR FAILURE TO DISPLAY TAGS OF $5.00.AND INCREASING
THE PENALTY ASSESSMENT FOR FAILURE TO HAVE RABIES VACCINATION
FROM $10.00 TO $15.00
WHEREAS, the City Council has been presented by the
administration with a series of changes to the City's animal code
as to increase various charges and fines to better administer dog
vaccinations and impoundment,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 5-28, Subsection (b) ~ the Municipal Code
of the City of Aspen, Colorado, is hereby amended to read as follows:
(b)
The annual fee for licensing a dog shall be
Two Dollars ($2.00), which fee shall be paid
by the o%~er to the veterinarian at the time
of inoculation. ~his fee shall be considered
a license tax and shall be remitted by the
veterinarian to the City Finance Director with-
in ten (10) days following the end of the
calendar month in which such dog was inoculated.
Section 2
~hat Section 5-31 of the Municipal Code of the City of Aspen,
Colorado, is hereby amended to read as follows:
Section 5-31 Procedure and compliance with articles
required for dogs imported into City
Ail dogs which are brought into the City shall be in
compliance with the laws and rules and regulations of
the state regarding the handling of the animal and
shall have been vaccinated not more than twelve (12)
months prior to importation. The tag denoting
vaccination shall be firmly affixed to the collar or
harness of the dog, and shall be evidence of compliance
with this section. If the imported dog remains in the

City more than thirty (30) days, such dog shall
be licensed in accordance with the provisions
of this article. Any legally acceptable certifi-
cation of the vaccination issued by a legally
authorized person to the owner of the dog, in any
municipality, county or state, shall be exchanged
for a current vaccination license tag of the City,
which tag shall bear the date of vaccination shown
on the aforesaid certificate. A transfer fee of
Two Dollars ($2.00) shall be paid by the dog owner
to the poundmaster at the time the exchange tag
is issued, which fee shall be remitted to the City
Finance Director by the poundmaster in the same
manner as license fees under Section 5-28 hereof.
Section 3
That Section 5-45 of the Municipal Code of the City of
Aspen, Colorado, is hereby amended to read as follows:
Section 5-45 Notice to owner; redemption
When any dog is impounded, as provided in Section 5-44,
it shall be the duty of the animal warden to make
reasonable efforts to notify the owner, possessor or
person who harbors the same, if known, which shall in-
clude mailing a notice of impoundment to the owner of
any licensed dog at the address of such owner given on
any license records. If the owner or possessor is not
known or cannot be contacted directly, the animal
warden shall post at City Hall and at thepound a notice
containing a description of such dog and information
as to when and where caught. A charge of Five Dollars
($5.00) is hereby made for the impounding of any dog;
and an additional charge of Five Dollars ($5.00) per
day is hereby made for each day, or part thereof, the
dog is kept in the pound, including the day of impound-
ing. No dog shall be released from the pound until
the owner shall have paid all charges for impounding
the dog, and until the dog has been licensed and
vaccinated in accordance with this article.
Section 4
That Section 5-68, Subsection(c) of the Municipal Code of
the City of Aspen, Colorado, is hereby amended to read as follows:
(c)
The penalty assessment and the nature of the
violation for which the penalty assessment may
be accepted and paid by the violator under the
privileges of this section shall be as follows:

(1) Failure to display tags.

(3) No rabies vaccination.

offense after the second, the
penalty assessment shall increase
Twenty Dollars ($20.00) for each
additional offense, up to the maxi-
mum fine permitted by law.
Section 5
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such invalidity
shall not affect other provisions or applications of the ordinance
which can be given effect without the invalid provisions or applica-
tions, and to this end the provisions or applications of this
ordinance are declared to be severable.
Section 6
A public hearing on this ordinance shall be held on the
22nd day of March, 1976, at 5:00 P.~. in the City Council Chambers,
Aspen City Hall, Aspen, Colorado.
