ORDINANCE NO. 21

AN ORDINANCE k~ENDING EXCEPTION NO. 2 OF SECTION I076(a) OF THE
UNIFORM BUILDING CODE SUCH AS TO DELETE THE EXCEPTION FOR ENCLOSURES
FOR ESCALATORS ~ND SUBSTITUTE A PROVISION ELIMINATING, IN F ~D G
OCCUPANCIES EQUIPPED WITH AUTOMATIC FIRE EXTINGUISHING SYSTEMS
THROUGHOUT, THE REQUIREMENT OF ENCLOSURES FOR OPENINGS WHICH SERVE
~0 ADJACENT FLOORS ~ICH ARE NOT CONCEALED WITHIN THE BUILDING
CONSTRUCTION, PROVIDED AT EACH FLOOR A DRAFT CURTAIN AND AUTOMATIC
FIRE SPRINKLERS ARE INSTALLED AROUND THE PERIMETER OF THE OPENING
AND WITHIN TWO FEET OF THE DRAFT CURTAIN
~i~EREAS, the Aspen City Council has received a recommenda-
tion from its Board of Appeals and Examiners for a building code change
which the Council feels appropriate,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
?hat the Municipal Code of the City of Aspen, Colorado,
hereby amended by adding Subsection (o) to Section 7-141 which said
subsection reads as follows:
(o) The Uniform Building Code, 1973 Edition, is hereby
amended by the repeal and reenactment of Exception No. 2
of Section 1706(a) which said exception on reenactment
shall read as follows:
In buildings housing Groups F and G occupancies equipped
with automatic fire-extinguishing systems throughout,
enclosures will not be required for openings which ~erve
two adjacent floors and are not connected with.openings
serving other floors and which are not concealed within
the building construction, ~rovided at each floor a
draft curtain and automatic-'fire sprinklers are installed
around the perimeter of the opening within two feet of
the draft curtain. The draft curtain shall enclose the
perimeter of the unenclosed opening and extend from the
ceiling downward at least twelve inches on all sides.
The spacing between sprinklers shall not exceed six feet.
DROVIDED, HOWEVER, that anything herein to the contrary
notwithstanding, ~.~ith regard to stairways which are re-
quired by this code, the provisions of Sections 3308 and
3309 herein shall apply.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, ~uch

invalidity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provisions
or applications, and to this end the provisions and applications of
this ordinance are declared to be severable.
Section 3
A public hearing on this ordinance shall be held on the
o~/~.ay of ~'~__~, 1976 at 5:90 P.~!. in the City Council
Chambers, Aspen City Hall, Aspen, Colorado.
