AN ORDINANCE AMENDING SECTION 24-3.2 OF THE ASPEN MUNICIPAL CODE SUCH
AS TO INCLUDE MUSEUMS AS CONDITIONAL USES WITHIN THE R-6 RESIDENTIAL
ZONE DISTRICTS; AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING
I~EDIATE ENACTMENT HEREOF
WHEREAS, the Aspen Planning and Zoning Commission, after
public hearing and deliberation, has concluded that museums are an
appropriate conditional use in the R-6 Residential Zone District (and
consequently the R-15, R-30 and R/MF Districts which incorporate the R-6
conditional uses by reference) and the City Council agrees with this
determination,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 24-3.2 of the Municipal Code of the City of
Aspen, Colorado, is hereby amended by the inclusion (in the Permitted
and Conditional Use Chart of Section 24-3.2) of museum as a CONDITIONAL
USE in the R-6 zone district.
Section 2
if any provision of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall not
affect other provisions or applications of the ordinance which can be
given effect without the invalid provisions or applications, and to this
end the provisions or applications of this ordinance are declared to be
severable.
Section 3
That there is pending at least one building permit applica-
tion for construction of a museum within an R-6 district which would be
seriously hampered by prolonged ordinance adoption procedures and the
Council is of the opinion that the public good will be enormously en-
hanced by the intended construction; and, consequently, that an

emergency exists requiring the immediate passage hereof. Adoption
of this ordinance shall require passage at two meetings of Council,
provided that neither a public hearing nor first publication shall
be required. This ordinance shall take effect upon final passage and
publication shall be within ten (10) days after final passage, or as
soon thereafter as possible.
