AN ORDINANCE AMENDING SECTIONS 2-79 AND 2-82
OF THE ASPEN MUNICIPAL CODE SO AS TO PROVIDE THAT
ALL CITY PERSONNEL WHO WORK ON ROTATING SHIFTS
SHALL NOT BE PAID TIME AND ONE-~ALF FOR
HOLIDAYS WORKED, BUT SHALL IN LIEU OF HOLIDAYS,
BE CREDITED WITH NINE (9) ADDITIONAL VACATION
DAYS PER CALENDAR YEAR.
WHEREAS, the City Council has been advised that
through the years the City has broadened the scope of municipal
services so that now services are offered which require employee
work patterns different from the traditional forty hour, five
day week schedules, and
WHEREAS, the City Council wishes to amend its adminis-
trative code so that those employees working rotating shifts
not be eligible for time and one-half for holidays worked, but
in lieu thereof, shall receive additional vacation time.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Section 2-79 of the Municipal Code of the City
of Aspen, Colorado, is hereby amended to read as follows:
Sec. 2-79 Holiday Work
A permanent or probationary employee for the
city shall, except as provided for herein, be
compensated for time worked on holidays at the
rate of time and one-half or by equal time off
as agreed upon by employee and supervisor concerned.
Police personnel, and all other employees working
on rotating shifts, shall be granted extra vacation
allowance in lieu of holidays worked as provided in
Section 2-82.

Section 2
That Section 2-~2 of the Municipal Code of the City
of Aspen, Colorado, is hereby amended to read as follows:
Sec. 2-82 Vacation Leave for Policemen and
Others Working Rotating Shifts
Police personnel, and all other employees working
on rotating shifts, shall be credited with nine
calendar days (but no more than 72 hours) of
additional vacation allowance in lieu of holidays
worked. This vacation allowance shall be credited
at the end of each completed year of service and
pay shall be based on current basic salary.
Section 3
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid pro-
visions or applications, and to this end the provisions or appli-
cations of this ordinance are declared to be severable.
Section 4
A public hearing on this ordinance shall be held
