HomeMy WebLinkAboutordinance.council.068-76RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~__ (Series of 1976) ~N ORDINANCE REPEALING AND REENACTING SUBSECTIONS (a) AND (b) OF SECTION 22-12.1 OF THE ASPEN MUNICIPAL CODE; WHICH AMENDMENTS PROHIBIT VEHICULAR TRAFFIC IN ALLEY 89 EXCEPT BY PERMIT ISSUED BY THE CITY MANAGER OR IN CASE OF EMERGENCIES WHEREAS, the City Manager has requested additional authority to regulate traffic within alley 89 to facilitate his management of pedestrian mall related traffic, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 22-12.1, subsection (a) of the Municipal Code of the City of Aspen, Colorado, is hereby repealed and reenacted to read as follows: (a) All vehicular traffic is prohibited within the pedestrian mall (as defined in Ordinance 20, Series of 1973) and within alley 89; provided that the city manager may permit service and delivery vehicles, vehicles of medical personnel and of those desiring access to privately owned parking areas, to enter into areas of the pedestrian mall and alley 89, and to park therein, for such periods and under such conditions as he may determine (taking into considera- tion the need for such services, deliveries and access, the level of traffic congestion within the area, and the public safety). Section 2 That Section 22-12.1, subsection (b) of the Municipal Code of the City of Aspen, Colorado, is hereby repealed and reenacted to read as follows: RECORD OF PROCEEDINGS 100 Leaves (b) The provisions of subsection (a) to the contrary notwithstanding, all firefighting equipment, ambulances, police vehicles, other emergency vehicles, private vehicles carrying the injured or ill, public vehicles, and public utility vehicles may enter into the pedestrian mall and alley 89 and park therein when necessary to render medical, police, utility or other public services, or aid to an injured or ill person, but only at such times, and for such periods as necessary to render such services. Section 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 4 A public hearing on the ordinance shall be held on ~-~-~ ~ , 1976, at 5:00 P.M. in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
