AN ORDINANCE AMENDING THE DOG CONTROL CODE OF
THE CITY OF ASPEN BY THE ADDITION OF SECTION 5-38
THERETO WHICH SAID SECTION MAKES IT UNLAWFUL TO
BRING OR TETHER ANY DOG IN ANY PEDESTRIAN MALL
AREA (AS NOW EXISTS OR ~%Y BE EXPANDED) AND IMPOSING
A PENALTY ASSESSMENT THEREFORE IN THE AMOUNT OF
TWENTY DOLLARS
WHEREAS, the City Council is of the opinion that it
is imperative to exclude all dogs from the mall area and wishes
to do so,
HOW, THEREFORE, JE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That the Municipal Code of the City of Aspen, Colorado,
is hereby amended by adding a section which said section reads
as follows:
Section 5-38 Dogs Prohibited in Mall Areas
It shall be unlawful for any owner, possessor or
person who keeps any dog to bring it into, or tether
it within, any area of the Aspen pedestrian mall as
it now exists or may be modified; provided, however, that
the provisions of this section shall not apply to the
use of seeing eye dogs by the blind.
Section 2
That the Municipal Code of the City of Aspen, Colorado,
is hereby amended by adding a subsection to Section 5-68(c)
which said subsection reads as follows:
(7) Dog in mall area $20.00

If any provision of this ordinance or the application
to any person or circumstance is held invalid, such

invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of
this ordinance are declared to be severable.
Section 4
A public hearing on the ordinance shall be held on
1976, at 5:00 P.M. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
INTRODUCED, READ AND ORDERED published as provided
by law by the City Council of the City of Aspen, Colorado, at
