(Series of 1977) AN ORDINANCE ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1976 EDITION, TOGETHER WITH THE UNIFORM BUILDING CODE STANDARDS, 1976 EDITION; AMENDING CERTAIN SECTIONS OF SAID CODE; PROVIDING PENALTIES FOR THE VIOLATIONS OF SAID CODE; AND REPEALING SECTIONS OF THE MUNICIPAL CODE INCONSISTENT THEREWITH WHEREAS, the City Council desires to adopt, for the benefit of the City of Aspen, the 1976 edition of the Uniform Building Code, to repeal existing building code provisions, and implement recommended changes to the 1976 edition. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. Repeal of Existing Sections That sections 7-140, 7-141, and 7-142 of Chapter 7 of the Municipal Code of the City be repealed and reenacted as follows: Section 2. Adoption of the Uniform Building Code That section 7-140 of the Municipal Code of the City of Aspen, Colorado, is hereby repealed and reenacted to read as follows: "Section 7-140 Uniform Building Code Adopted. ~ursuant to the power and authority conferred by the laws of the State of Colorado and the Charter of the City of Aspen, Colorado, it is hereby adopted as the building code of the City of Aspen, Colorado, by reference thereto, the Uniform Building Code, 1976 edition (including the appendix, excepting Chapters 13, 15, 38, 48, and 49 thereof) but excepting Section 204 of such code concerning the board of appeals, published by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California, RECORD OF PROCEEDINGS 100 Leaves together with the Uniform Building Code Standards, 1976 edition, of the International Conference of Building Officials, at the same address, all to have the same force and effect as though set forth herein in every particular." Section 3. Adoption of Amendments Thereto That section 7-141 of the Municipal Code of the City of Aspen, Colorado, is hereby repealed and reenacted to read as follows: "Section 7-141. Amendments (a) The Uniform Building Code, 1976 Edition, Sec. 104(j is hereby amended to read as follows: 'Sec. 104(j) Historic Buildings. Repairs, alterations and additions necessary for the preservation, restoration, rehabilitation or continued use of a building or structure may be made without conformance to all the requirements of this code when authorized by the building inspector provided: 1. The building or structure has been determined to be of historic, architectural or geographic importance and has received historic designation pursuant to the provisions of Article IX of Chapter 24 of the Aspen Municipal Code; provided, however, that the automatic inclusion of a structure within a larger historic overlay district shall not constitute, without more, a designation of historic, architectural, or geographic importance sufficient to meet the requirements of this sub- paragraph. 2. Any unsafe conditions as described in Section 203 will be corrected in accordance with approved plans. 3. Any substandard conditions will be corrected in accordance with approved plans. -2- RECORD OF PROCEEDINGS 100 Leaves (b) 4. The restored building or structure will be less hazardous, based on life and fire risk, than the existing building. The Uniform Building Code, 1976 edition, is hereby amended by adding number eight to Section 301(b): 'Sec. 301(b) Application. 8. Be accompanied by a recent survey, plat and legal description of the proposed building site or property prepared by a registered land surveyor licensed to practice in the State of Colorado at time of application for a building permit. The surveyor making the plat shall certify on the plat that it is correct and that the perimeter monuments described in it have been placed as described, after which he shall affix his name and seal. Permanent reference monuments shall be set and marked. Permanent reference monuments under normal geographic and topographic conditions shall be 3/4" nominal iron pipe (1.05 inches O.D.) or #5 steel rebar 24 inches long with a metal or plastic cap at least 1 3/8 inches in diameter set that no more than 4 inches protrudes from the ground and mounded with stones. Said plat should indicate the following: (a) Type of monuments set on property corners. (b) The location and dimensions of any easements or rights-of-way of record or in evidence on said property. The above requirements shall not be mandatory for a building permit application to reconstruct or remodel totally within the limits of an existing building or structure. For improvements to be located on large tracts of -3- RECORD OF PROCEEDINGS 100 Leaves (c) (d) land (5 acres or over) the provisions of section 301(b) shall not apply; but, evidence satisfactory to the building official must be submitted which shows the improvement on the property to be in compliance with appropriate laws.' The Uniform Building Code, 1976 edition, is hereby amended by adding number nine to Section 301(b) which said subsection shall read as follows: 'Sec. 301(b) Application 9. When construction is proposed in the special flood hazard areas, be accompanied by elevations (in relation to mean sea level) of the lowest floor (including basement) of all new or sub- stantially improved structures located in the special flood hazard areas. If the lowest floor is below grade on one or more sides, the elevation of the floor immediately above must also be submitted.' Section 302(d) of the Uniform Building Code 1976 edition is hereby amended to read as follows: 'Sec. 302(d) Expiration. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within one hundred twenty (120) days from the date of issuance of such permit. Work equal to ten (10) percent of the valuation of the entire project must be completed in each sixty-day period thereafter until completion of the project or said project shall be deemed abandoned and the permit expired. In the event a permit shall expire, the following provisions shall apply, namely: -4- RECORD OF PROCEEDINGS 100 Leaves (e) 1. All below grade excavation done in anticipation of construction shall be filled within thirty (30) days of expiration such as to bring the site to a condition comparable to that before permit issuance. 2. Any fences, railings, canopies and other pro- tective structures placed in a public right-of-way, and required by Chapter 44 of the Uniform Building Code, shall be removed within ten (10) days of expiration of a permit as well as all hazardous conditions eliminated. 3. Before such work can be recommenced a new permit shall be first obtained so to do. Such permit shall issue for a permit fee equal to one-half the amount required for a new permit for such work provided no changes have been made or will be made in the plans and specifications for such work, and provided further that the work has not been abandoned for a period exceeding one year. 4. The provisions of subparagraph 3 to the contrary notwithstanding, no permit shall reissue for any construction or activity prohibited by law at the time of the application for reissuance. Whenever there are practical difficulties or unnecessary hardships in the way of carrying out the strict letter of this section, the Board of Appeals, on appeal thereto, may vary or modify the application of this section so that the intent and purpose of the code will be observed, public safety and welfare secured, and substantial justice done.' Table 5-C, 5-D and 17-A of the Uniform Building Code, 1976 edition, are hereby amended by changing the title of the ninth column entitled "l-hour" to read "l-IIr, RECORD OF PROCEEDINGS 100 Leaves (f) or H.?.' Section 1302(b) of the Uniform Building Code, 1976 edition, is hereby amended to read as follows: ' (b) Special Provisions. Group R, Division 1 Occupancies, more than two stories in height or having more than 3000 square feet of floor area above the first story, shall be not less than one- hour fire-resistive construction throughout. EXCEPTION: Dwelling units within an apartment house not over two stories in height may have nonbearing walls of unprotected construction, provided the units are separated from each other and from corridors by construction having a fire- resistance rating of not less than one hour. Openings to such corridors shall be equipped with doors conforming to Section 3304(h) or other equi- valent protection. Every apartment house, lodging house, dormatory, convent, monastery, rooming house, condominium or hotel, two stories or more in height and containing more than four dwelling units and/or guest rooms shall have installed therein an approved fire alarm system as specified in the amended Sec. 13.307 of the Uniform Fire Code. For Group R, Division 1 Occupancies with a Group B, Division 1 parking garage in the basement or first floor, see Section l102(a). For attic space partitions and draft stops see Sec- tion 3205. Mandatory Mailboxes. Within all zone districts within the City of Aspen no multi-family structure consisting of three or more units receiving mail shall be constructed without the installation there- -6- RECORD OF PROCEEDINGS 100 Leaves in of individual mail boxes sufficient to service all anticipated occupants of the structure and meeting any applicable requirements of the U.S. Postal System for mail delivery.' (g) Section 1501 of the Uniform Building Code, 1976 edition, is hereby amended by deleting the words "over 6 feet high" in Division 2 Occupancies and to read as follows: 'Sec. 1501 Division 2. Fences, tanks and towers. Outside the city limits of Aspen a building permit is not required for a fence under six (6) feet high.' (h) Chapter 15 of the Uniform Building Code, 1976 edition, is hereby amended by adding thereto the following as Section 1507: 'Sec. 1507 Fences and Retainin~ Walls. 1. No barbed wire or sharp fence, and no electronically charged fence, shall be erected or maintained within the city limits of Aspen. 2. On corner lots, no fence, retaining wall, shrub, tree or similar obstruction shall be erected or maintained which obstructs the traffic vision, nor on corner lots shall any fence, retaining wall, shrub, tree or similar obstruction be erected or maintained which exceeds a height of 42 inches, measured from street grade, within 30 feet from the lot corner. 3. Any dangerous fence or obstruction in violation of subsection 2 above, shall be removed when so ordered by the building official.' (i) Sections 1602(a) and (b) of the Uniform Building Code, 1976 edition, are hereby amended to read as follows: 'Sec. 1602(a) General. Buildings or structures -7- RECORD OF PROCEEDINGS 100 Leaves (j) hereafter erected, constructed, moved within or into Fire Zone No. 1 shall be only of Type I, Type II-F.R., Type III one-hour, or Type IV construction, and shall meet the requirements of this section. Except fences less than six (6) feet in height may be of Type V construction. Roof coverings shall be fire retardant as spe- cified in Section 3203(e). for repairs. Sec. 1602(b). Alterations. See section 104(f) No building of Type II, One-hour or II-N construction nor any building of Type V construction already erected in Fire Zone No. 1 shall hereafter be altered, raised, enlarged, added to or moved, except as follows: 1. Changes, alterations and repairs to the interior of such building or to the front thereof facinga public street may be made, provided such changes do not, in the opinion of the building official, increase the fire hazard of such building. 2. Roof coverings shall be fire retardant as specified in Section 3203(e). See Section 104(f) for repairs. 3. Such building may be moved entirely out- side the limits of Fire Zone No. 1. 4. Such building may be demolished. Section 1603(a) and (b) of the Uniform Building Code, 1976 edition, is hereby amended to read as follows: 'Sec. 1603(a) General. Buildings or structures hereafter erected, constructed, moved within or into Fire Zone No. 2 shall be one of the types of con- struction as defined in this code and shall meet the requirements of this section. Except that any --3-- RECORD OF PROCEEDINGS 100 Leaves (k) Type II, One-hour or II-N building shall only be be permitted for Section 1501, Group M Division 1 occupancies within the city limits of Aspen. For fire-resistive protection of exterior walls and openings, as determined by location on property, see Section 504 and Part V. Roof coverings shall be fire-retardant as specified in Section 3203(e). See Section 104(f) for repairs. Sec. 1603(b) Alterations. No building of Type II, One-Hour or II-N construction nor any building of Type V construction already erected in Fire Zone No. 2 shall hereafter be altered, raised, enlarged, added to or moved except as follows: 1. Such building may be made to conform to the provisions of Section 2203 for Type V construction. 2. Changes, alterations and repairs to the interior of such building or to the front thereof facing a public street may be permitted provided such changes do not in the opinion of the building official, increase the fire hazard of such building. 3. Roofs of such building may be covered only with a fire-retardant roofing as specified in Section 3203(e). See Section 104(f) for repairs. 4. Such building may be moved entirely outside the limits of Fire Zone No. 2. 5. Such building may be demolished. 6. Combustible finish on the outside walls may be replaced by or covered with exterior plaster as specified in Chapter 47.' Section 1604 of the Uniform Building Code, is hereby amended to read as follows: 'Sec. 1604. Any building or structure with the requirements of --9-- 1976 edition, complying this code may be erected RECORD OF PROCEEDINGS 100 Leaves (1) (m) constructed, moved within or into Fire Zone No. 3, except that any Type II, One-hour or II-N building shall only be permitted for Section 1501, Group M Division 1 occupancies within the city limits of Aspen.' Section 1705(d) (2) of the Uniform Building Code, 1976 edition, is hereby amended to read as follows: 'Sec. 1705(d) (2). Wood veneer of boards not less than 1-inch nominal thickness or exterior type panels not less than 3/8 inch nominal thickness may be applied to one hundred (100) per cent of the wall area of the first story and thirty-three and one- third (33 1/3) per cent of the wall area for each story above the first story provided such veneer shall be placed either directly against fire-resistive non- combustible surfaces or furred out from such surface not to exceed 1 3/4" (inches) with all concealed spaces fire stopped as provided in Section 2517(f).' Exception No. 2 of Section 1706(2) of the uniform Building Code, 1976 edition, is hereby amended to read as follows: 'Sec. 1706(a) Exception No. 2. In building housing Group B occupancies equipped with automatic fire- extinguishing systems throughout, enclosures will not be required for openings which serve two (2) adjacent floors and are not connected with openings serving other floors and which are not concealed within the building construction, provided at each floor a draft curtain and automatic fire sprinklers are installed around the perimeter of the opening within two (2) feet of the draft curtain. The draft curtain shall enclose the perimeter of the underclosed opening and extend from the ceiling -10- RECORD OF PROCEEDINGS 100 Leaves (n) (o) downward at least twelve (12) inches on all sides. The spacing between sprinklers shall not exceed six (6) feet. Provide~ however, that anything herein to the contrary notwithstanding, with regard to stairways which are required by this code, the provisions of Sections 3308 and 3309 herein shall apply.' Section 2103(a) 5 of the Uniform Building Code, 1976 edition, is hereby amended to read as follows: 'Sec. 2103(a)5. Wood columns, beams and arches conforming to heavy timber sizes may be used externally where exterior walls are permitted to be unprotected non-combustible construction or one-hour fire-resistive non-combustible construction.' Section 2201 of the Uniform Building Code, 1976 edition, is hereby amended to read as follows: 'Sec. 2201. Type V buildings may be of any materials allowed by this code. Type V, one-hour buildings shall be of one-hour fire-resistive construction throughout. Type V, heavy timber construction shall conform to section 2106 except that permanent partitions (non-bearing exterior walls) and members of the structural frame may be of other materials, provided they have a fire resistance of not less than one hour. Materials of construction and fire-resistive requirements shall be as specified in Chapter 17. For requirements due to occupancy, see Chapters 6 to 15, inclusive. For requirements in Fire Zones, see Chapter 16. -11- RECORD OF PROCEEDINGS 100 Leaves (P) (q) Table No. Edition, 8 at the 33-A of the Uniform Building Code, 1976 is hereby amended by addition of footnote end of Table 33-A and 8 inserted after the title in the fourth column. Footnote 8 to read as follows: ,8 Not required in one or two story buildings for the floor above or the floor below the floor closest to grade.' Section 3801 of the Uniform Building Code, 1976 edition, is hereby amended by the addition of subsections (e), (f) and (g) to read as follows: 'Sec. 3801(e). A visual signal shall be required whenever an audible alarm signal is required for an automatic fire alarm system. The visual signal shall meet the following requirements: 1. The light used shall be of the strobe type producing at least one million candle power, or incandescent flashing type which can be plainly seen for at least 1,500 feet in all directions of approach. 2. Lights are to be red in color for systems equipped with a fire department connection and yellow in color for systems not having a fire department connection. 3. In systems with a fire department connection the light is to be located at least 12' above and as directly vertical to the fire department con- nection as possible. In systems without fire department connection the light is to be located so as to be visible from the nearest street. 4. A sign with the words "Fire, Call Fire Depart- ment'' (black on a white background and large -12- RECORD OF PROCEEDINGS 100 Leaves (r) enough to be visible from the center of the adjacent street) shall be mounted directly above the light. 5. The light shall not replace the audible alarm, but is to be used in conjunction with it. 6. The visual and audio signal shall be together on a circuit separate from all others except exit signs. 'Sec. 3801(f) An inside audible alarm is to be installed wherever an alarm is required by Sec. 13.307 of the Uniform Fire Code or Sec. 3802 of the Uniform Building Code, except in single family, duplex, tri- plex and fourplex residential dwellings. In the case of public assembly areas with an occupant load of one hundred (100) or more persons, or where in the opinion of the Building Official or the Fire Marshall, the installation of an inside alarm may result in creating panic, the alarm signal shall be installed in an attended area, (e.g. projection booth, manager's office) from where there can be effectuated an orderly evacuation of the assembly area pursuant to a system approved by the Building Official or Fire Marshall.' 'Sec. 3801(g) All fire alarm systems within the city in operation on the effective date of this ordinance shall, within one year of said effective date, be brought into conformance with the above requirements.' Table 43-C of the Uniform Building Code, 1976 edition, is hereby amended by adding subsection (c) to footnote 14 to read as follows: ' (c) Topping of Grade A or B concrete not less -13- RECORD OF PROCEEDINGS 100 Leaves (s) than 1½" thickness may be substituted for the finish flooring required in subsections (a) and (b) above.' Insulation Code. The Uniform Building Code, 1976 edition, is hereby amended by the addition of Chapter 53 to such code, which said Chapter reads as follows: 'Chapter 53 Energy Conservation and Thermal Insulation. Purpose: 'Section 5301. This section encourages minimum fossil fuel consumption by establishing minimum thermal insulation standards for all occupancies and the use of innovative energy conservation tech- niques in buildings. Application and Scope: Section 5302. This Section shall apply to all buildings and structures in use Groups A (Assembly), E (Educational), I (Institutional), B (Business) and R-1 (Hotels and Apartments). Definitions: Section 5303. For the purposes of this Section, the following definitions shall apply: ASHRAE is the American Society of Heating, Refriger- ation and Air Conditioning Engineers. DEGREE DAY is a unit, based upon temperature differ- ence and time, used in estimating fuel consumption and specifying nominal heating load of a building in winter. For any one day, when the mean tempera- ture is less than 65°F, there exist as many degree days as there are Fahrenheit degrees difference in temperature between the mean temperature for the day and 65°F. GLAZING is all transparent or translucent materials in exterior openings. -14- RECORD OF PROCEEDINGS 100 Leaves EXTERIOR WALL AREA is the gross area of wall surfaces adjacent to heated spaces, including glazing and doors, exposed to ambient climatic temperatures measured for a dwelling unit or group of units served by a heating system. INFILTRATION is air flowing inward as through a wall, crack, etc. SPECIAL GLAZING is glazing which has a minimum U factor of .70 for all glazed surfaces. THERMAL CONDUCTIVITY (K-FACTOR) is the time rate of heat flow through one square foot of homo- geneous material one inch thick when there is a temperature difference of one degree F. between the opposite faces of the material expressed in B.t.u./hour, square foot, degree F. per inch. THERMAL RESISTANCE (R) is the measure of the resistance of a material or building component to the passage of heat. The resistance value (R) of mass-type insulations shall not include any value for reflective facing. TRANSMISIVITY is the capacity of a material to transmit radiant energy. U FACTOR is the total heat flow through a given construction assembly, air to air, expressed in B.t.u./hour, per square foot, per degree F. temperature difference. I U=~t where Rt equals the sum of the resistance (R) for the individual components of the assembly. U factors shall be calculated according to ASHRAE methods. -15- RECORD OF PROCEEDINGS 100 Leaves UNHEATED SPACES are any spaces exposed to ambient temperatures and not provided with a heat supply capable of maintaining a minimum temperature of 45°F. Section 5304. Building Insulating Material Standards 1. Ail materials used in the insulation of buildings in order to comply with this section shall conform with the following standards: Cork board Cellular glass Expanded polystyrene insulation board Fiberboard Insulation Board (Urethane) Insulation, Thermal (Perlite) Mineral fiber, pouring or blowing Mineral wool Mineral wool (roof) Perlite, Silicone treated loose fill *Reflective, thermal *Structural fiberboard insulating roof deck Vegetable or wood fiber Vermiculite Vermiculite, water repellant loose fill Wood fiber blanket F.S. HH-I-561 F.S. HH-I-551 F.S. HH-I-524 F.S. LLL-1535 or ASTM C-208, Class C F.S. HH-I-530 F.S. HH-I-574 F.S. ItH-I-1030 F.S. HH-I-521 F.S. HH-I-~26 FHA UM-37 F.S. HH-I-1252 AIMA IB Spec F.S. HH-I-515 F.S. fill-I-585 FHA UM-30 CS-160 a. Expanded perlite: F.G. IIH-I-526 may be modified to permit the basic material to be a mineral substance made of rock, slag or a mixture thereof, processed from a natural state into fiberous or cellular form with a minimum density of 8 lbs. per cubic foot. b. Perimeter insulation shall comply with the FHA test procedure, "Test Procedure to Determine Acceptability of Perimeter Insulation for Concrete Floor on Ground" dated June, 1956. e Labeling: Mineral Fiber Insulation shall be labeled as follows: a. Blanket type, or combination blanket with reflective facing: (1) Name of manufacturer or distributor (2) Insulation type (3) Thermal resistance "r" value of insulation fiber at the labeled insulation thickness. Type I blankets with no membrane cover may either bear a label on a partial membrane facing or may be branded with vertical stripes. -16- RECORD OF PROCEEDINGS 100 Leaves Three stripes indicates the thermal resistance R equals 11. Five stripes indicates a resis- tance R equals 19. No lower "R" value is acceptable. Types II and III blankets with non-reflective and reflective membrane coverings respectively, shall be labeled with appropriate "R" value of 7, 11, or 19. No lower "R" value is acceptable. d. ?hermal resistance "R" values apply to mineral fiber only. 2.1 Reflective Insulation a. Blanket Type (1) Name of manufacturer or distributor (2) Insulation type (3) Thermal resistance "R" value. (R value to include single or multi-layers, foil or kraft backed, one or both sides.) (4) Designate direction of heat flow. Identification labeling and marking of all other acceptable building insulating material shall comply with their apprpriate standard listed in this section. Section 5305. and Walls 1. Ceilings: Thermal Design Standards for ceilings The maximum U-value for ceilings shall be 0.05. Ail occupancies with a floor to ceiling height in excess of twelve feet shall have a maximum U-value for ceilings of 0.04. 2. Walls: a. All buildings and structures in Group R-1 shall have a maximum U-value for walls above grade of 0.05. Masonry and structural concrete walls have a maximum U-value of .085 if the insula- ting materials are placed on the wall's exterior. b. All buildings and structures in Groups A, E, I, and B shall have a maximum U-value for walls above grade of 0.085. c. ~alls of unheated spaces need not be insulated. d. Basement walls below grade shall have a maximum U-value of 0.09. This is required if the base- -17- RECORD OF PROCEEDINGS 100 Leaves ment space is provided with a positive heat supply to maintain a minimum temperature of 50OF. Section 5306. slabs-on-Grade 1. Floor Section, Foundation Walls and Ail buildings and structures in Group R-1. a. Floors over unheated basements, crawl spaces and garages: The maximum U-value shall be 0.05 or the walls of the foundation shall be insula- ted to a depth of the footings with a maximum U-value of 0.09. b. Slabs-on-Grade: Perimeter insulation shall be required from the top edge of the slab to a depth of 2 feet below grade. The maximum U-value shall be 0.1. c. Structural concrete mats on grade shall be required to perimeterly insulate the full depth of the mat. The maximum U-value shall be 0.1. All buildings and structures in Groups A, E, I, and B-2. a. Floors over unheated basements, crawl spaces: The maximum U-value shall be 0.08 or the walls of the foundation shall be insulated to a depth of the footings with a maximum U-value of 0.09. b. Slabs-on-Grade: Perimeter insulation shall be required from the top edge of the slab to a depth of 2 feet below grade. The maximum U-value of the insulation shall be 0.2. c. Structural concrete mats on grade shall be required to perimeterly insulate the full depth of the mat. The maximum U-value shall -18- RECORD OF PROCEEDINGS 100 Leaves be 0.1. Section 5307. Thermal Design Standards for Glazing 1. All windows, skylights, and doors shall be glazed with insulating glass as defined in the ASHRAE Guide - double glazing - or shall be equipped with storm windows and storm doors. Closure providing equivalent resistance to heat transmission will be acceptable. EXCEPTION: All buildings in Group B-2 may use single glazing for display areas which are com- pletely sealed from the interior heated spaces. 2. The total glazing area of a building shall not exceed 14% of the total floor area for all classes of structures. a. Skylights shall be included as glazing areas in these calculations. b. South facing glazing of a buildin~ i.e., glazing oriented between the true bearings 165°-195°, shall not be restricted as to total glass area upon meeting the following requirements: (1) South glazing shall be clear and untreated. (2) The total combined glazing area on all other exposures (compass coordinates other than 165°-195°) shall not exceed 12.3% of the total floor area for all classes of structures. Skylights shall be included as glazing areas. Section 5308. Heat Distribution Equipment 1. Minimum R value of piping insulation R=3.7 Section 5309. Infiltration 1. Caulking and Sealing: Exterior joints around windows and door frames, between wall and founda- tions, between wall and roof, between wall panels, at penetrations of utility services through walls, floors and roofs, and all other openings in the exteriors envelope shall be caulked, gasketed or otherwise weather-stripped. 2. All buildings in Groups A, E, I, and B-2 shall be required to institute entrance sealing by using doubled entrance systems. Section 5310. Requirement for Day-i~ight Thermostats All structures in groups A, E, I, and B-2 shall be required to install day-night thermostats to reduce heating demand during periods when building is not occupied. Section 5311. Design Conditions 1. All R-1 and I group structures shall use an outside design temperature of -15°F. 2. All buildings in groups A, E, and B-2 shall use an outside design temperature of -10°F. Section 5312. Design Flexibility Structures shall be exempt from sections 5304, 5305, and 5309 5307/of Chapter 53 Energy Conservation and Thermal Insulation upon meeting all the following requirements: 1. All calculations for determination of the design heating load shall use the following design con- ditions: a. All R-1 and I structures shall use an outside design temperature of -15°F, interior design temperature of 70OF. b. All buildings in groups A, E, and B-2 shall use an outside design temperature of -10°F, interior design temperature of 70~F. 3. The building department will require calculations by a registered professional engineer or architect in the State of Colorado to justify compliance with the requirements of Chapter 53. Such calcu- lations shall conform to the procedure outlined by the American Society of Heating, Refrigeration Air Conditioning Engineers. Section 5313. Exemptions to Chapter 53 Requirements All dwelling units approved by the Colorado Division of Housing as meeting the mobile home standard ANSI 119.1, and all R-Division 3 residences, shall be exempt from the provisions of this Chapter 53. Section 4. Adoption of Penalties That Section 7-142 of the Municipal Code of the City of -21- RECORD OF PROCEEDINGS 100 Leaves Aspen, Colorado, is hereby repealed and reenacted to read as follows: "Section 7-142 Violations and Penalties (a) It shall be unlawful for any person, corporation to erect, firm or construct, enlarge, alter, repair, move, improve, remove, equip, use, occupy or maintain structure in the city or cause convert or demolish, any building or the same to be done, contrary to or in violation of any of the provisions of this code. (b) Any person, firm or corporation violating any of the provisions of the code shall be deemed guilty of a misdemeanor, and each person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, con- tinued or permitted, and upon conviction of any such violation such person shall be punished by a fine of not more than Three Hundred Dollars ($300.00), or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment." Section 5. Description of Code That the uniform Building Code, 1976 edition, and the Uniform Building Code Standards, 1976 edition, hereinabove adopted by reference, are designed to encourage development of better building construction and public safety. Said code establishes administative procedures for issuance of building permits; describes building requirements based on the type of occupancy, location of fire zones and types of construction; prescribes engineering regulations and standards for fire protection; provides for types of wall and ceiling coverings and construction of special structures. -22- RECORD OF PROCEEDINGS 100 Leaves Section 6. Certification on Adoption That on passage of this ordinance, and adoption of these codes by reference, one of the copies of the primary code and of each secondary code may be kept in the office of the chief enforcement officer instead of the office of the City Clerk. Following the adoption of any of these codes, the City Clerk shall at all times maintain a reasonable supply of copies of the primary code and of any secondary codes incorporated in it by reference available for purchase by the public. Section 8. Repeal of Inconsistent Ordinances That existing ordinances or parts of ordinances covering the same matters as embraced in this ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the pro- visions of this ordinance are hereby repealed, except that this repeal shall not prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 9. Partial Invalidity If any provision of this ordinance or the application thereof to any person or circumstance shall be found to be invalid, such invalidity shall not affect any remaining portion or application which can be given effect and to this end this ordinance is declared to be severable. -23- RECORD OF PROCEEDINGS 100 Leaves Section 10.
