AN ORDINANCE REPEALING AND REENACTING CHAPTER 6
OF THE ASPEN MUNICIPAL CODE CONCERNING BICYCLES;
REQUIRING REGISTRATION OF BICYCLES AND PROVIDING
FOR VIOLATIONS AND PENALTIES
WHEREAS, the City Council desires to repeal the
existing provisions of Chapter 6 of the Aspen Municipal Code
and to reenact Chapter 6 of the Aspen Municipal Code with
recommended changes for the benefit of the City of Aspen,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Chapter 6 of the Aspen Municipal Code entitled
"Bicycles" be repealed and reenacted to read as follows:
CHAPTER 6
BICYCLES
Sec. 6-1. Definitions.
Bicycle. The term "bicycle" shall mean and include
any conveyance upon which a person may ride propelled
wholly or in part by human muscular power and having
two (2) tandem wheels.
Sec. 6-2. Registration and Tag or Decal Requirements
for Operation or Rental.
(a) No person shall operate a bicycle upon any public
street, upon any public path set aside for the use of
bicycles, or other public place within the City of Aspen
unless such bicycle has been registered with the Aspen
Police Department as evidenced by a valid registration
decal attached to such bicycle, as provided in this
chapter.
(b) No person, firm or corporation engaged in the

business of renting bicycles for hire in the City of Aspen
shall rent or offer for rent any bicycle which has not
been registered with the Aspen Police Department as
evidenced by a vaild registration decal attached to
such bicycle, as provided in this chapter.
Sec. 6-3. Application for Registration.
Each application for a bicycle registration, or for a
transfer thereof, shall be made to the police depart-
ment on a form approved by the chief of police. Such
application shall set forth the name and address of
the owner, a description of the bicycle, the name of
the manufacturer, and the serial number appearing on
the frame of the bicycle.
Sec. 6-4. Registration Fee.
No fee shall be required for registration of bicycles
pursuant to this chapter.
Sec. 6-5. Issuance of Registration Decal.
(a) The police department may cause an inspection to
be made of each bicycle for which an application is made,
under Section 6-3, as to its safe mechanical condition,
and as to the ability of the applicant to operate the
bicycle safely. Maintenance of a bicycle in a safe
mechanical condition is the sole responsibility of the
owner.
(b) Upon approval of the application, the police depart-
ment shall ingrave an identification number on the
bicycle frame and issue a registration decal for each
bicycle.
Sec. 6-6. Affixing and Disply of Tag or Decal.
The registration decal shall be attached to the bicycle
in a conspicuous place.

Sec. 6-7. Renewal.
No renewal of bicycle registation shall be necessary.
Sec. 6-8. Responsibility on Transfer of Title of Bicycle.
When the bicycle has been sold or ownership transferred,
the bicycle shall be registered in the name of the person
to whom such sale or transfer was made, within seven (7)
days of such sale or transfer.
Sec. 6-9. Records to be Kept by the Police Department.
The police department shall keep a record of the regis-
tration of all bicycles.
Sec. 6-10. Replacement of Stolen, Lost or Mutilated
Decals.
Whenever an issued registration decal is lost, stolen
or mutilated, a replacement (registration) decal shall
be obtained from the police department.
Sec. 6-11. Removal, Alteration or Defacing Decals and
Bicycle Identification Numbers Prohibited.
(a) No person shall remove, destroy, mutilate or alter
any registration decal.
(b) No person shall remove, destroy, n~tilate or alter
the identification number on the frame of any bicycle
or have in his possession any bicycle on which said number
is removed, destroyed, mutilated or altered.
Sec. 6-12. Police Inspection; Impounding and Release of
Bicycle.
(a) The police of the City of Aspen may inspect any
bicycle on any public street or place at any time to
ascertain whether or not it (1) has been properly regis-
tered; or (2) has a valid registration decal properly
fixed thereto; and (3) is in proper mechanical condition

to be operated safely.
(b) In the event that a bicycle is being used or
operated without a vaild registration decal, or is in
such condition as to be unfit for safe operation,
or there is a failure to comply with the requirements
of this chapter, the police may impound the bicycle
until such time as the owner or registrant has procured
the necessary registration decal, or has rendered the
bicycle safe for use, or has fully complied with all
requirements of this chapter.
Sec. 6-13. Violation and Penalty.
violation of any provision of this chapter by any person,
firm or corporation is declared to be unlawful. Any
person, firm or corporation who violates any provision
of this article shall, upon conviction thereof, be
punished by a fine not exceeding $50.00.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this
ordinance are declared to be severable.
Section 3
A public hearing on the ordinance shall be held on
, 1977, at 5:00 P.M. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
