ORDI~ANCE NO. 46

AN ORDINANCE A~fENDING CERTAIN SECTIONS OF
ARTICLE VI OF CHAPTER 2 (EMPLOYEE BENEFITS
AND REGULATIONS), SPECIFICALLY (1) SEC. 2-76(a)
ELIMINATING LONGEVITY INCREASES, ?~DUCING
PROBATIONARY PERIODS TO SIX (6) MONTHS WITH
THE EXCEPTION OF SWORN POLICE OFFICERS, AND
PROVIDING FOR COST OF LIVING AND MERIT INCREASES;
(2) SEC. 2-78(7) ADDING COLORADO DAY AS A HOLIDAY;
(3) SEC. 2-~8 PROVIDING FOR CONVERSION OF SiCK LEAVE
UPON RETIREMENT OR RESIG~ATION IN GOOD STANDING;
(4) SEC. 2-91 ~%~NDING THE PAY GRADE SCHEDULE;
(5) SEC. 2-92 BY ADDI~G THE CITY/COUNTY PLANNER;
AND (6) DELETING SEC. 2-D3 POSITION CLASSIFICATIONS
AND RAY SCHEDULES OF POLICE DEPARTMENT EMPLOYEES
WHEREAS, the Aspen City Council has been presented with
a series of amendments to the wage and vacation provisions of
the Aspen Municipal Code and wishes to adopt the same,
HOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 2-76, subsection (a) of the Municipal Code
of the City of Aspen, Colorado, is hereby amended to read as
follows:
(a) Employees shall be employed in accordance with
their respective pay grade number classification as
determined by the pay schedule and position classi-
fication in effect at the time of their employment
and shall commence under Step A for six (6) months
probationary period with the~exception of sworn
police officers which shall be twelve (12) months;
thereafter, upon approval of the City ~anager, such
employees may be raised to Steps B, C, D, E, ? and G
(or half steps between). The City Manager and the
Finance Director upon approval of the City Council
shall determine a cost of living increase during budget
sessions each year. Every employee shall receive this
cost of living increase each year, one year from his
last raise date. ]~erit increases must be approved by
both the department head and the city manager. No
longevity increases shall be awarded to employees but
nothing herein shall be construed to eliminate longe-
vity increases awarded prior to or enjoyed before
March 15, 1976.
Section 2
5'hat subsection 2-78(7) of the ~unicipal Code of the City
of Aspen, Colorado, is hereby repealed and reenacted to read

as follows:
(7) The first Monday of August (Colorado Day)."
Section 3
That Section 2-~33 of the Municipal Code of the City of
Aspen, Colorado, is hereby amended to read as follows:
Sec. 2-88 Sick leave
Sick leave will be granted to every officer or
employee in the City service, except temporary
or seasonal employees, on the basis of one (1)
day for each month worked. For periods of sick
leave over two (2) days' duration, the employee
shall, at his expense, and on request of the
City Manager only, furnish the department a
certficate or letter from the attending doctor
setting forth the reasons for the sick leave.
Abuse of such leave shall be grounds for dis-
ciplinary action up to and including discharge.
Sick leave may be accumulated up to ninety (90)
days. l~hen an employee retires or resigns in good
standing with the City of Aspen, after six (6)
months' ~mployment, said employee may convert sick
leave at a 3 to 1 ratio for pay purposes with
approval from the City Manager.
Section 4
That Section 2-91 of the Municipal Code of the City of
Aspen, Colorado, is amended to read as follows:
Sec. 2-91 Pay schedule; position classification
The employees' compensation plan with salaries for
all pay grades is hereby adopted according to the
following schedule in dollars per calendar month:

On approval of the head of an employee's department
one-half step raises (consisting of two (2%) percent
increments) may be recognized in the ab4ve schedule
and be granted an employee in lieu of full step increases.
The pay schedule applicable to the respective classes
of positions, as designated by pay grades, are as
follows:

That- Section 2-92 of the Municipal Code of the City of Aspen,
Colorado, is hereby amended to read as follows:
Sec, 2-92
Employment of director of finance and planner
at salary above that provided in SectiOn
2-91
Whenever, in the opinion of and on the recommendation
of, the city manager, a candidate or a person presently
filling the officers of director of finance or planner,
presents credtials or experience or ability meriting
appointment or continuation in office at a salary greater
than the maximum salary provided for in section 2-91
the city council may, by motion, approve such increased
salary. The director of finance and the planner so
appointed shall enjoy cost of living increases without
additional concouncil approval, but no subsequent base
salary increases shall occur without notice to and
approval by the city council.
Section 6
That Section 2-93 of the Municipal Code of the City of Aspen,
Colorado, is hereby deleted.
Section 7
If any provision of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity shall
not affect the other provisions or applications of the ordinance

which can be given effect without the invalid provisions or
applications, and to this end the provisions or application of
this ordinance are declared to be severable.
Section 8
A public hearing on the ordinance shall be held January 23,
1977, at 5:00 p.m. in the City Council Chambers, Aspen City Hall,
Aspen, Colorado.
INTRODUCED READ AND ORDERED published as provided by law by
the City Council of the City of Aspen, Colroado, at its regular
meeting held at the City of Aspen on the 19th day of December
1977.
