ORDINANCE NO. 37

AN ORDINANCE A~NDING SECTION 24-8.18 OF THE
ASPEN MUNICIPAL CODE TO ESTABLISH A SLOPE DENSITY
REDUCTION FORMULA
WHEREAS, the City Council of the City of Aspen wishes to
amend Section 24-8.18 of the Aspen Municipal Code for the
benefit of the City of Aspen,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That Section 24-8.18 of the Aspen Municipal Code is hereby
repealed as reenacted to read as follows:
Sec. 24-8.18. Reduction in density for slope
consideration.
(a) In order to control development potential so as
to (1) reduce wildfire, mudslide and avalanche hazards,
(2) enhance soil stability, and (3) guarantee adequate
fire protection access, the overall density of a planned
unit development shall be reduced in areas with slopes
in excess of twenty (20) percent in the following manner:
(1) using a topographic map prepared by a registered
land surveyor, the entire land ownership, excluding
existing rights-of-way and easements, shall be
divided into the following classifications:
lands between 0% and 20% slope;
lands between 21% and 30% slope;
lands between 31% and 40% slope;
lands in excess of 40% slope.
(2) allowable density shall then be calculated
according to the following formulas:

For lands between 0 and 20% slope, the
density shall be that allowed in the existing
zone district;
For lands between 21% and 30% slope, the
density shall be reduced to 50% of that
allowed in the existing zone district.
~or lands between 31% and 40% slope, the
density shall be reduced to 25% of that
allowed in the existing zone district.
For lands in excess of 40% slope, no density
credit shall be allowed.
(3) density shall then be calculated by totaling
the square footage resulting from these
formulas in each slope classification and
dividing by the square footage necessary
in the existing zone district per dwelling.
(b) For property lying within more than one zone
district, the density reduction calculation shall be
performed separately on the lands within each district.
(c) Slopes in excess of forty per cent (40%) shall be
considered for development only upon receipt of the
approval of the planning commission.
Section 2
if any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of
this ordinance are declared to be severable.

That a public hearing be held on this ordinance on

City Council Chambers, Aspen City Hall, Aspen, Colorado, 15 days
prior to which hearing notice of the same shall be published
once in a newspaper of general circulation within the City of
Aspen.
