AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION
IN THE 6TH PENNY SALES TAX FUND THE AMOUNT OF
$25,000.00 FROM UNAPPROPRIATED REVENUES;
RECOGNIZING A $25,900.00 CONTRIBUTION; APPRO-
PRIATE EXPENDITURES OF $25,000.00 FOR LAND
PURCHASE; AND DECLARING THAT AN EMERGENCY
EXISTS REQUIRING IMMEDIATE ENACTMENT
WHEREAS, by virtue of Section 9.12 of the Home Rule
Charter, the City Council may make supplemental appropriations;
and
WHEREAS, the City Manager has certified that the City
has recognized an unanticipated, additional $25,000.00 in
revenues in the form of a gift by citizens; and
WHEREAS, the City Council is advised that certain revenues
and expenditures must be recognized and approved, and be so
before the end of the calendar year,
?IOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
Upon the City Manager's certification that there are
available for appropriation revenues in excess of those
estimated in the budget, the City Council hereby makes
a supplemental appropriation of unappropriated revenues
of $25,000.00 in the 6th Penny Sales Tax Fund and appropriating
expenditures in the amount of $25,000.00 for the purpose of
purchasing property known as the Horowitz property.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
or the ordinance which can be given effect without the

invalid provision or application, and to this end the pro-
visions of this ordinance are declared to be severable.
Section 3
That it hereby is declared that an emergency exists
requiring the immediate adoption of this ordinance inasmuch
as all budget ordinances for 1978 revenues or expenditures
must be fully approved by the City's governing body before
the end of this calendar year; that this ordinance be approved
only by the unanimous vote of councilm~n present or a vote of
five councilmen, whichever is less;
passed at two meetings of council;
nor first publication be required;
published within ten (10) days after final passage;
