ORDINANCE NO. 57
(Series of 1978)
AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION
IN THE 6TH PENNY SALES TAX FUND FROM NOTE PROCEEDS
OF $500,000.00; FROM ADDITIONAL SALES TAX
REVENUES OF $25,000.00; AND RECOGNIZING A
$50,000.00 CONTRIBUTION; APPROPRIATE
EXPENDITURE OF $575,000.00 IN THE CALENDAR
YEAR 1978 AND DECLARING THAT AN EMERGENCY
EXISTS REQUIRING IMMEDIATE ENACTMENT
WHEREAS, by virtue of Section 9.12 of the Home Rule
Charter, the City Council may make supplemental appropriations;
and
WHEREAS, the City Manager has certified that there are
available for appropriation $25,000.00 in revenues in excess
of those anticipated in the budget, the City has recognized
$500,900.30 in new revenue from note proceeds, and the City
has recognized an unanticipated, additional $50,000.00 in
new revenue in the form of a gift by citizens; and
WHEREAS, the City Council is advised that certain
revenues and expenditures must be recognized and approved,
and be so before the end of the calendar year,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
Upon the City Manager's certification that there are
available for appropriation revenues in excess of those
estimated in the budget, the City Council hereby makes
a supplemental appropriation of unappropriated revenues
of $575,300.00 in the 6th Penny Sales Tax Fund for the purpose
of purchasing property known as The Aspen One Property and
appropriating expenditures in the amount of $75,000.00
payable in calendar year 1978 with $500,000.00 payable
in future years.

If any provision of this ordinance or the applicatiQn
thereof to any person or circumstance is held invalid, such

invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the
invalid provision or application, and to this end the pro-
visions of this ordinance are declared to be severable.
Section 3
That it hereby is declared that an emergency exists
requiring the immediate adoption of this ordinance inasmuch
as all budget ordinances for 1978 revenues or expenditures
must be fully approved by the City's governing body before
the end of this calendar year; that this ordinance be approved
only by the unanimous vote of councilmen present or a vote of
five councilmen, whichever is less; that this ordinance be
passed at two meetings of council; that neither a public hearing
nor first publication be required; that this ordinance be
published within ten (10) days after final passage; and that
it take effect upon final passage.
