AN ORDINANCE AMENDING SECTION 23-22 OF THE
ASPEN MUNICIPAL CODE PROVIDING FOR PAYMENT
OF CHARGES FOR ELECTRICAL SERVICE AND THE
REMEDIES FOR NONPAYMENT THEREOF
WHEREAS, the City Council desires to amend Section 23-22
of the Aspen Municipal Code providing for payment of charges
for electrical service and the remedies for nonpayment thereof,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That Section 23-22 of the Aspen Municipal Code is hereby
repealed and reenacted to read as follows:
Sec. 23-22. Payment of charges for service; lien
and collection of nonpayment.
(a)
The manager shall disconnect the electrical service
to any consumer who fails to pay any electric
service charges when the same shall become due.
(b)
Ail the rates and charges specified in the approved
schedules shall be paid by the owner of the premises
on which the electric power was used, or the occupant
thereof, and all such rates and charges from the
time the same shall be due and payable shall become
and remain a lien upon the premises until such rates
or charges shall be paid and such rates and charges
for electric power may be collected against any
owner or occupant by suit, such action to be
brought in the name of the city in any court having
jurisdiction thereof, and shall be prosecuted as
an action in personam against the owner or occupant
or by an action in rem for the enforcement of the
lien or both.
(c)
Any lien for unpaid electric power rates and
charges against any premises may also be collected
as provided by the statutes of the state for the
collection of taxes and other liens and assessments
against real estate.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end the provisions of this
ordinance are declared to be severable.

Section 3
A public hearing on the ordinance shall be held on
