ORDINANCE NO. 48

AN ORDINANCE VACATING THE ALLEGED CITY ROAD, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
A tract of land situated in the SE 1/4 of the NE 1/4 of
Section 12, Township 10 South, Range 85 West of the Sixth
Principal Meridian, City of Aspen, County of Pitkin, State of
Colorado, consisting of the 30-foot wide road in the Aspen
Company Subdivision, more particularly described as follows:
Beginning at a point whence a U.S. brass cap dated 1954 and
marked as the East Quarter corner of said Section 12 bears S
55°43'55'' E 1096.78 feet;
thence West 108.99 feet;
thence 75.24 feet along the arc of a curve to the left having
a radius of 60.30 feet and whose chord bears S 54°15'10" W
70.46 feet;
thence 67.06 feet along the arc of a curve to the right
having a radius of 332.28 feet and whose chord bears N
18°14'40'' E 66.94 feet;
thence 37.27 feet along the arc of a curve to the right
having a radius of 90.30 feet and whose chord bears N
78o10'29" E 37.01 feet;
thence East 108.99 feet;
thence South 30.00 feet to the point of beginning,
Beginning at a point whence a U.S. brass cap dated 1954 and
marked as the East Quarter corner of said Section 12 bears S

thence North 30.00 feet;
thence East 174.04 feet;
thence South 30.00 feet;
thence West 174.04 feet to the point of beginning,

WHEREAS, the public use, convenience and necessity no
longer requires the aforementioned alleged City road or portion
thereof; and
WHEREAS, the aforementioned alleged City road provides access
to the Aspen Center for Environmental Studies; and
WHEREAS, the City desires to limit access to the Aspen Center
~or Environmental Studies.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
The alleged City road, more particularly described as:

Section 2
The right-of-way vacated above is vacated pursuant to the
provisions of Section 24-2.5 and the lands acquired as a result of
said vacation shall be excluded from further calculations of
allowable density or required open space in future development.
Section 3
If any provision of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity
shall not affect other provisions or applications of the ordinance
which can be given e~fect without the invalid provision or
application, and to this end the provisions of this ordinance are
declared to be severable.
Section 4
A public hearing on the ordinance shall be
