AN ORDINANCE ZONING THE WATER PLANT SITE WHICH LAND
HAS RECENTLY BEEN ANNEXED TO THE CITY OF ASPEN
PURSUANT TO ORDINANCES NOS. 43, 49, AND 51, SERIES OF 1979,
THE COLORADO MUNICIPAL ANNEXATION ACT
AND
WHEREAS, the City Council has recently annexed the Water
Plant Site to the City of Aspen and is therefore required, by the
Colorado Municipal Annexation Act, to zone the same within 90 days
of the effective date of the annexation proceedings, and
WHEREAS, the Aspen City Council desires that the 63-acre
tract annexed by the City should be appropriately zoned Specially
Planned Area (SPA); and,
WHEREAS, the ten (10) foot section owned by the County should
be appropriately zone R-15;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That from and after the effective date of this ordinance the
following described property shall be zoned SPA (Specially Planned
Area), and subject to those zoning regulations applicable to said
zone district and described in Chapter 24 of the Aspen Municipal
Code (as now exists or may hereafter be amended):
A parcel of land situated in the Southwest Quarter of Section
12, and the Northwest Quarter of Section 13, both sections
being in Township 10 South, Range 85 West of the 6th
Principal Meridian, Pitkin County, Colorado, and being fully
described as follows:
Beginning at a point on the Southwesterly right-of-way of
Castle Creek Road, said point being N 79'10'17" W, 822.48
feet from the unapproved 1954 (1978) Bureau of Land Manage-
ment brass cap monument for the Northwesterly corner of Sec-
tion 13, Township 10 South, Range 85 West of the 6th Princi-
pal Meridian; thence S 23'41' W, 730.07 feet; thence N 89*52'
W, 534.72 feet more or less to the Westerly boundary of said
Section 13; thence Southerly along the Westerly boundary of
Section 13, S 00*03'40" E, 2205.10 feet more or less to the
West Quarter corner of Section 13, an unapproved 1954 Bureau
of Land Management brass cap monument; thence N 89*36' E,

671.87 feet; thence N 44°10' E, 78.51 feet; thence N 33°15'
E, 450.45 feet more or less to the Westerly right-of-way line
of Castle Creek Road; thence Northerly along the Westerly and
Southwesterly right-of-way line of Castle Creek Road N 15°53'
E, 975.00 feet; N 09°14' E, 738.34 feet; N 07°01' W, 262.69
feet; N 33°27' W, 181.00 feet; N 44"09' W, 150.70 feet; N
52°46' W, 276.67 feet; N 43°17' W, 111.14 feet to the point
of beginning containing 64.383 acres more or less.
Section 2
That from and after the effective date of this ordinance the
following described property shall be zoned R-15, and subject to
those zoning regulations applicable to said zone district and
described in Chapter 24 of the Aspen Municipal Code (as now exists
or may hereafter be amended):
A parcel of land situated in the SW 1/4 of Section 12,
Township 10 South, Range 85 West of the 6th Principal
Meridian, Pitkin County, Colorado, and being more fully
described as follows:
Beginning at a point on the westerly right-of-way line of
Castle Creek Road, said point being N 70"10'49" E, 808.00
feet from a 1954 brass cap set for the southwesterly corner
of said Section 12, Township 10 South, Range 85 West of the
6th Principal Meridian; thence S 21"23'00" E, 117.07 feet
along the westerly right-of-way line of Castle Creek Road;
thence S 23"41'00" W, 14.13 feet; thence N 21~23'00" W,
127.48 feet; thence N 71~00'00" E, 10.01 feet to the point of
beginning, containing 1,223.19 square feet more or less.
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 4
That a public hearing be held on this ordinance on the /~'~

the City Council Chambers, Aspen City Hall, Aspen, Colorado,
fifteen (15) days prior to which hearing notice of the same shall
be published once within a newspaper of general circulation within
the City.
