A~ O~DINA~CE ~EXI~G CERTAIN U~INCO~O~TED ?E~ITO~Y TO ?HE
CITY OF ASPEN, COLORADO
WHEREAS, there has been submitted a Petition for
Annexation of certain unincorporated territory to the City of
Aspen, which Peitition has been found to be in compliance with
Section 31-8-107(1)(c), C.R.S. 1973, a part of the Colorado
Municipal Annexation Act, and
WHEREAS, the City Council has considered the proposed
annexation as described in the Petition for Annexation
(hereinafter "Petition") and accompanying plat, and has
letermined that:
1. The signatures on the Petition represent the owners
of one hundred percent (100%) of the land proposed for
annexation.
2. Not less than one-sixth (1/6) of the perimeter of
the area to be annexed is contiguous to the City of
Aspen.
3. There exists a community of interest between the
tracts to be annexed and the City of Aspen; the tracts
to be annexed are integrated or capable of being inte-
grated with the City of Aspen.
4. The annexation will not affect the constitution of
any existent school district.
5. The Petition satisfies the statutory requirements of
the Municipal Annexation Act, both as to substance and
form; and
WHEREAS, the Colorado Municipal League Annexation Act
Provides that where a Petition is signed by owners of one
hundred percent (100%) of the property proposed to be annexed,
the City Council, may, by ordinance, annex without notice or
hearing (other than that incident to ordinance adoption) and
without election, and the City now wishes to so proceed:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1
That the following-described tract be and hereby is
annexed to the City of Aspen, Colorado, pursuant to the
Colorado Municipal Annexation Act:
Ail of the following parcel of land except that
located within the City of Aspen as of
October 16, 1979, specifically being all of
Block 62, City and Townsite of Aspen, all of
Block 1, Eames Addition to the City and Town-
site of Aspen, that part of the old Colorado
Midland Railroad right of way located South-
westerly of said Block 1, Eames Addition and
those parts of unplatted portion of Eames Add-
ition to the City and Townsite of Aspen and
Charles H. Jacobs Lot and the alley in Block 1
said Eames Addition lying within the following
described parcel, to-wit:
Beginning at the Northeasterly corner of said
Block 62; thence S 14°50'49'' W, 3i6.33 feet
along the Easterly line of said Blocks 62 and
1 to the Southwesterly line of the railroad
right of way; thence N 42°27'42'' W, 320.82
feet along said right of way line to a line
projected Southerly from the Westerly line of
said Block 1; thence N 14°50'49'' E, 143.05 feet
along said projected line to the Northwesterly
corner of said Block 1; thence S 75°09'11'' E,
270.00 feet along the Northerly line of said
Block 1 and 62 to the point of beginning. Said
parcel, including that portion located within
the City of Aspen as of October 16, 1979,
contains 62,016 square feet more or less.
Section 2
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the
invalid provisions or applications, and to this end the pro-
visions or applications of this ordinance are declared to be
severable.
Section 3
That a public hearing be held on this ordinance on~~

City Council Chambers, Aspen City Hall, Colorado.
