AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF
$67,000.00 FROM THE CURRENT YEAR UNAPPROPRIATED SALES TAX
REVENUES, RECOGNIZING A TRANSFER OF $124,573.00 FROM THE
TRANSPORTATION/MALL FUND TO THE TRANSIT FUND AND APPROPRIATING
$57,573.00 FROM TRANSPORTATION/MALL FUND PRIOR YEAR FUND BALANCES
WHEREAS, the City Manager has certified that there are
available for appropriation revenues in excess of those estimated
in the budget; and
WHEREAS, the City Manager has certified that the City has
recognized an unanticipated, additional $67,000.00 in sales tax
revenues, and
WHEREAS, for the purpose of bus operating and capital
expenditures the amount of $124,573.00 is tranferred from the
Transportation/Mall Fund to the Transit Fund; and
WHEREAS, the City Council is advised that certain revenues
and expenditures must be recognized and approved.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO;
Section 1
Upon the City Manager's certification that there are avail-
able for appropriation revenues in excess of those estimated in
the budget, the City Council hereby makes a supplemental appropri-
ation of Current Year Unappropriated Sales Tax Revenues in the
amount of $67,000.00 of prior year unappropriated Transportation/
Mall Fund balances in the amount of $57,573.00 and of transferred
Transportation/Mall Fund revenues in the amount of $124,573.00 to
the Transit Fund.
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
