ORDINANCE NO. 52
(Series of 1980)
AN ORDINANCE REGULATING TAXICABS
WHEREAS the City Council desires to amend Chapter 12 of the
Municipal Code of the City of Aspen by the addition of an article
which regulates taxicabs for the benefit of the City of Aspen,
and
WHEREAS~ public advertisement of rates and the use of taxi-
meters will aid in the enforcement of and insure the uniform
application of rates all for the protection of the public health~
safety and welfare.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN. COLORADO~
Section 1
That Chapter 12 of the Municipal Code of the City of Aspen~
which sets forth licenses and permits generally shall be amended
by the addition of a new Article IV which shall read as follo%;s:
ARTICLE IV
Sec. 12-60. Purpose.
The purpose of this regulation is to insure the fair and
equal application of established rates to all members of the
general public by requiring that the same be posted in full
view of all passengers and requiring the installation and use
of taximeters.
Sec~ 12-61. Definitions.
(1) Taxicab. "Taxicab" shall mean any motor vehicle used to
transport persons for hire, having a seating capacity of not
more than eleven (11) persons, not including the driver;
except motor vehicles operated pursuant to governmental
transportation entities.
(2) Operator. "Operator" shall mean any person, partner-
ship, corporation, association or other organization engaged
in the business of transporting persons for hire by means of
one or more than one taxicab.
(3) Driver. "Driver" shall mean any person who drives a
taxicab and may include an operator or any employee of an
operator.
(4) Taximeter "Taximeter" shall mean a meter, instrument
or device attached to a taxicab which measures mechanically

the distance driven and the waiting time upon which the fare
is based.
(5) Rate Card. "Rate card" shall mean a card prepared by
the operator for display in each taxicab which contains the
rates of fare then in force.
Sec. 12-62. Required Equipment.
It shall be unlawful to operate a taxicab as a con, on carrier
over any public street, road or highway of this city unless
said taxicabs shall be equipped with functioning and accurate
taximeters fastened in front of the passengers, visible to
them at all times day and night; and after sundown, the face
of the taximeter shall be illuminated. No taxi shall be
operated with paying passengers without said taximeter. Each
taximeter shall have thereon a flag to denote when the vehi-
cle is employed and when it is not employed; and it shall be
the duty of the driver to throw the flag of such taximeter
into a non-recording position at the ter~iination of each
trip.
Annual certification of accuracy shall be required under
regulations promulgated by the city manager which regulations
shall require certification of each taximeter for accuracy on
October 1 of each year and may require the payment of a
reasonable fee to cover the expenses of inspection. Taxi-
meters certified after October 1 of any year shall be certi-
fied only until October 1 of the following year.
Sec. 12-63. Rates.
It shall be unlawful for any owner or driver of a taxicab
to charge a greater sum for the use of a taxicab than the
rates established by the Colorado Public Utilities Commis-
sion. Every taxicab operated as a common carrier over any
public street~ road or highway of this city shall have a rate
card setting forth the authorized rates of fare displayed in
such a place as to be in full view of all passengers.
Section 2
The provisions of this ordinance shall become effective
December 1, 1980.
Section 3
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
