HomeMy WebLinkAboutordinance.council.007-74RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 7 (Series of 1974) AN ORDINANCE VACATING A PORTION OF A PLATTED RIGHT OF WAY ABUTTING WHAT IS PRESENTLY BEING USED AS MILL STREET IN THE CITY OF ASPEN, COLORADO WHEREAS, Richard Schottland is the owner of real property adjacent to a parcel of land constituting a part of a platted street located within the City of Aspen, Colorado, which parcel is more particularly described as: A tract of land situated in the southwest one-quarter of Section 7, Township l0 South, Range 84 West of the 6th Principal Meridian, Pitkin County, Colorado, being more fully described as follows: Beginning at a point whence the west quarter corner of said Section 7 (a brass cap in place) bears N 31°33'58'' W 1565.89 feet; thence S 89o25'42'' E 31.30 feet; thence S 20°16'00'' W 220.30 feet; thence N 75°09'11'' W 9.53 feet; thence N 14°50'49'' E 211.60 feet to the point of beginning, containing 0.098 acres more or less, and WHEREAS, Richard Schottland wishes to purchase such parcel from the City of Aspen and the City is agreeable to the sale thereof, such parcel no longer of public need nor intended for future public use, and WHEREAS, the City of Aspen, in order to transfer its interest in such parcel, must vacate the same by full ordinance procedure. RECORD OF PROCEEDINGS 100 Leaves NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. That in consideration of the compensation tendered to the City, the receipt of which is a condition of this vacation, that portion of the platted extension of Mill Street, more particularly described above, shall be and the same is vacated as a public right of way. Section 2. That this vacation shall not in any way effect or convey any interest in any existing easements for the use of sewer, gas, water, or similar pipelines and appurtenances, and for telephone, and similar lines and appur- ditches or electric, tenances. Section 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. Section 4. A public hearing on this ordinance shall be day of Chambers, held on the , 1974, at 5 P.M. in the City Council Aspen City Hall, Aspen, Colorado.
