AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE
CITY OF ASPEN, COLORADO, FOR THE PURPOSE OF PROVIDING
A SYSTEM OF TRAFFIC REGULATION CONSISTENT WITH STATE
LAW AND GENERALLY CONFORMING TO SIMILAR REGULATIONS
THROUGHOUT THE STATE; ADOPTING BY REFERENCE THE 1973
EDITION OF THE '~ODEL TRAFFIC CODE FOR COLORADO
MUNICIPALITIES"; REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH; AND PROVIDING PENALTIES FOR VIOLATION
THEREOF
WHEREAS, the City Council wishes to adopt the Model
Traffic Code for Colorado Municipalities, 1973 edition,
specify amendments thereto, and provide penalties for
violations thereof,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1. Repeal of Existing Section
That section 22.2 of Chapter 22

(b) Additions or modifications.
Colorado Municipalities", officially approved,
adopted and published in 1973 as such by the
State Department of Highways, Denver, Colorado,
and hereinafter referred to as the '~unicipal
Traffic Code," of which three copies are now
in the office of the Clerk of the City of

code is subject to the following additions and
modifications:
(1) Section 10-2. Model Traffic Code Section 10-2
is hereby amended to read as follows:
'Section 10-2. Obedience to angle parking
signs or markings. On those streets which
have been approved and signed or marked for
angle parking, no person shall stop, stand
or park a vehicle other than at the angle to
the curb or edge of the roadway indicated by
such signs or markings; and such vehicle shall
be so parked with its front right wheel no more
than six (6) inches from the curb.'
(2) Section 11-1. Model Traffic Code Section 11-1
is hereby amended with the addition of sub-
section (15) which subsection shall read:
'(15) Within two (2) feet of a walkway leading

to a residence where no sidewalk exists.'
(c) Penalties. The following penalties, herewith set
forth in full, shall apply to this section:
(1) It is unlawful for any person to violate any
of the provisions stated or adopted in this
section.
(2) Every person convicted of a violation of any
provision stated or adopted in this section
shall be punished by a fine not exceeding
three hundred dollars ($300.00), or by
imprisonment not exceeding ninety (90)
days, or by both such fine and imprisonment.
(d) Application. This ordinance shall apply to every
street, alley, sidewalk area, driveway, park, and
to every other public way or public parking area,
either within or outside the corporate limits of
this municipality, the use of which this munici-
pality has jurisdiction and authority to regulate.
The provisions of section 5-1, 5-2, 5-12 and 23-3
of the adopted Model Traffic Code respectively
concerning reckless driving, careless driving,
unauthorized devices, and accident investigation
shall apply not only to public places and ways
but also throughout this municipality."
Section 3. Repeal of Inconsistent Provisions
Existing ordinances or parts thereof covering the same
matters as embraced in this ordinance are hereby repealed

and all ordinances and parts of ordinances inconsistent with
the provisions of this ordinance are hereby repealed, except
that this repeal shall not affect or prevent the prosecution
or punishment of any person for any act done or committed in
violation of any ordinance hereby repealed prior to the
taking effect of this ordinance.
Section 4. Interpretation
This ordinance shall be so interpreted and construed as
to effectuate its general purpose to make uniform the local
traffic regulations contained herein. Article and section
headings of the ordinance and adopted Model Traffic Code
shall not be deemed to govern, limit, modify or in any
manner affect the scope, meaning or extent of the provisions
of any article or section thereof.
Section 5. Partial Invalidity
If any provision of this ordinance or the application
thereof to any person or circumstance shall be found to be
invalid, such invalidity shall not affect any remaining
portion or application which can be given effect and to this
end this ordinance is declared to be severable.
Section 6. Description of Code
The Model Traffic Code is a uniform code designed to
prescribe traffic and parking regulations, vehicle inspection,
and administration of traffic regulations within the City
of Aspen.
Section 7. Availability of Copies for Public Inspection
Three copies of the Model Traffic Code, all certified to

be true copies by the Mayor and City Clerk, shall be on file
with the City Clerk and shall be open for public inspection
in her office at the Aspen City Hall, Aspen, Colorado, any
weekday between the hours of 9 A.M. and 5 P.M., at least
fifteen days preceding the public hearing on this ordinance.
Section 8. Certification on Adoption
On passage of this ordinance, and adoption of this code
by reference, one of the copies of this code may be kept in
the office of the chief enforcement officer instead of in the
office of the City Clerk. Following the adoption of this
code, the City Clerk shall at all times maintain a reasonable
supply of copies of the code incorporated by reference herein
available for purchase by the public.
Section 9. Publication and Hearing
A public hearing on this ordinance shall be held on the
~ day of ~~ , 1974, at 5 P.M., in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
Pursuant to the provisions of Chapter 139 Article 34, C.R.S.
1963, notice of the hearing shall be published at least twice,
once at least eight (8) days preceding the hearing and once at
least fifteen (15) days preceding it.
INTRODUCED, READ AND ORDERED published as provided by law
by the City Council of the City of Aspen, Colorado, on the
