AN ORDINANCE ADOPTING BY REFERENCE THE NATIONAL
ELECTRICAL CODE, 1975 EDITION, (EXCEPT THE
APPENDIX); MAKING A GENERAL AMENDMENT THERETO;
REQUIRING COMPLIANCE HEREWITH; PROVIDING FOR
INSPECTION OF PREMISES SO AS TO ENFORCE THE
SAME; PROVIDING GENERAL REQUIREMENTS FOR
LIGHT, POWER OR HEATING INSTALLATIONS; GIVING
GENERAL SPECIFICATIONS FOR INSTALLATIONS; PROVIDING
THAT PERMITS BE OBTAINED FOR WIRING ALTERATIONS
AND ADDITIONS; PROVIDING THAT PERMITS BE OBTAINED
FOR INSTALLATION AND APPLIANCES; ESTABLISHING A
FEE SCHEDULE FOR THE ISSUANCE OF REQUIRED PERMITS;
REQUIRING THE BUILDING INSPECTOR TO KEEP RECORD
OF ALL PERMITS ISSUED; AND PROVIDING THAT NOTHING
HEREIN SHALL BE CONSTRUED TO L~SSEN THE RESPONSIBILITY
OR LIABILITY OF ANY PERSON OWNING, OPERATING,
CONTROLLING OR INSTALLING ANY ELECTRICAL EQUIPMENT
WHEREAS, the City Council wishes to adopt the 1975
edition of the National Electric Code, to provide for a
general amendment thereto to establish procedures for the
enforcement of the same,to adopt a schedule of fees for
permit issuance, and to repeal existing inconsistent
provisions,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That Sections 7-156 through 7-167 of the Aspen
Municipal Code be and hereby are repealed and reenacted
to read as follows:
"Sec. 7-156 National Electrical Code Adopted
Pursuant to the power and authority conferred by the
law of the State of colorado and the Charter of
the City of Aspen, Colorado, it is hereby
adopted as the electrical code of the City of Aspen,

the National Electrical Code, 1975 edition (except
the appendix), published by the National Fire
Protection Association, 470 Atlantic Avenue,
Boston, Massachusetts, 02210, all to have the
same force and effect as though set forth herein
in every particular.
Sec. 7-157 Amendment
The following general amendment is made to the
provisions of the National Electrical Code, 1975 edition,
herein adopted by reference:
Ail electrical wiring in Group A, B, C, D,
E, F and G occupancies, as defined in the
Uniform Building Code, shall be encased in
mental conduits, raceways, or in approved armor'
Sec. 7-158 Compliance Required
(a) It shall be unlawful for any person to install,
alter, repair or maintain any electrical conductors or
equipment within or on any public or private building
within the City of Aspen, or cause the same to be
done contrary to or in violation of any of the
provisions of the National Electrical Code, 1975
edition, as herein adopted.
(b) Any person, firm, or corporation violating any
of the provisions of the National Electrical Code,
1975 edition, shall be deemed guilty of a mis-
demeanor, and each such person shall be deemed guilty
of a separate offense for each and every day or
portion thereof during which any violation of any
of the provisions of this Code is committed,
continued or permitted, and upon conviction of any
such violation such person shall be punished by
a fine of not more than Three Hundred ($300.00
Dollars or by imprisonment for not more than
ninety (90) days, or by both such fine and im-
prisonment.
Sec. 7-159 Inspection
(a) Upon the completion of the wiring of any
building it shall be the duty of the person doing
the same to notify the building inspector, who
shall inspect the installation within twenty-four
(24) hours of the time such notice is given. If
the structure is found to be fully in compliance with
the Uniform Building Code and the electrical
service is fully in compliance with the National
Electrical Code adopted by reference in this
article and the other provisions of this article

and does not constitute a hazard to life and
property, he shall issue a certificate of
inspection authorizing connection to the electrical
service and the turning on of the current. All
wires which are to be hidden from view shall be
inspected before concealment, and the person,
firm or corporation installing such shall notify
the building inspector giving him twenty-four
(24) hours in which to make the required
inspection before the wires are covered. It shall
be unlawful for any person to fail or refuse to
give such notice as required herein.
(b) The inspector periodically shall make a
thorough examination of all the electrical wires
and appliances installed within the city. When
such wires or appliances are found to be in a
dangerous or unsafe condition, he shall notify
the person owning, using, operating or installing
the same to place them in a safe condition within
fifteen (15) days or such longer time as may be
deemed reasonable by the inspector.~ such notification
shall be in writing. It shall be unlawful for any
person to fail or refuse to obey such order. The
building inspector is hereby empowered to order
the disconnection of electrical service to any de-
fective installation or appliance if the same shall
constitute an immediate hazard to the public health,
safety and welfare.
Sec. 7-160. General requirements for light, power,
or heating installations
No certificate of inspection shall be issued unless
the electric light, power or heating installation and
all other electrical apparatus connected with it
are in strict conformity with all the provisions
of this article and the code adopted by reference
in this article and unless they are in conformity
with the latest and most approved methods of
construction for safety to life and property. The
regulations laid down in the National Electrical
Code, 1975 edition, of the National Fire Protection
Association shall be prima facie evidence of such
latest and most approved methods. It shall be
unlawful to energize any electrical installation or
equipment until a certificate of inspection has
been issued.
Sec. 7-161. Specifications for installations generally.
All service Conductors outside a building shall be
in approved conduits. The service cabinet shall
be so arranged that it shall not be over six (6)

feet above a permanent floor. The cabinet may be
located inside or outside the walls of buildings
in the nearest accessible place to the point where
the wires enter the building, but in no case shall
there be more than ten (10) feet of nonfused service
entrance wire or cable located within the confines
of any structures, except as provided in Section 230-
47 of the National Electrical Code, 1975 editiOn.~
Approved frangible padlocks may be placed on switch
handles to prevent opening and closing by
unauthorized persons with the prior approval of the
electrical inspector and the fire marshal. Current
metering devices shall be located outside the
building or in a location always accessible to the
electric utilities which complies with the National
Electrical Code requirements for service panel
access.
Sec. 7-162 Permit required for wiring alterations
and additions
It shall be unlawful for any person to make any
alterations or additions in existing wiring for the
placing of any electric lights, motors, heating
devices, or appliances requiring the use of
electric current, or m~e any alterations in any
electrical appliance or wiring without first
applying for and securing a permit therefor as
provided in this article. However, no permit shall
be required for minor repair work, such as repairing
flush and snap switches, replacing fuses, changing
lamp sockets and receptacles, taping bare wires and
repairing drop cords.
Sec. 7-163 Permit for wiring and appliances required
It shall be unlawful for any person to install any
electrical wires or appliances without first
obtaining a permit therefor from the building inspector.
Sec. 7-164 Same--Application
Application for permit to install electrical
wires and appliances shall be made to the building
inspector by the contractor or other person
installing such wires and appliances.
Sec. 7-165 Same--Fees
Where a permit is required for the installation of
electrical wiring, devices or appliances by this
article, the fees shall be as herein stated:

(i)
A minimum charge of two dollars ($2.00) for
the first circuit; each additional circuit
shall be one dollar ($1.00).
(2)
A minimum charge of one dollar ($1.00) for the
installation of five (5) openings or less;
additional openings shall be ten cents ($.10)
each.
(3)
Motors: The first motor shall be one dollar
and fifty cents ($1.50); each additional motor
shall be fifty cents ($.50)
(4) Heating devices shall be the same as motors.
(5)

Appliances with motors shall be the same as motors.
Incandescent signs or sign lights: There shall
be a minimum charge of two dollars ($2.00) per
one hundred and fifty (150) watt or less output.
Each additional fifty (50) watt output or
fraction thereof shall be fifty cents ($0.50).
(7)
Service entrance: The charge shall be one
dollar ($1.00) per one hundred (100) amps or
fraction thereof.
(8)
Transformers and rectifiers: The minimum
charge shall be two dollars ($2.00) for the
first ten (10) KVA or less. Each additional
ten (10) KVA or fraction thereof shall be
one dollar ($1.00)
Sec. 7-166. Record keeping required for building
inspector.
The building inspector shall keep a record of all
permits issued and inspections made under the
provisions of this article.
Sec. 7-167. Liability for damages.
This article shall not be construed to relieve from
or lessen the responsibility or liability of any
party owning, operating, con%rolling or installing
any electrical equipment for damages to anyone
injured or any property destroyed by reason of the
performance of any inspection authorized by this
article, or the issuance of any certificate of
inspection under the provisions of this article."
Section 2.
That the National Electrical Code, 1975 edition,
adopted hereinabove is designed for regulating the
installation, alteration, repair and maintenance of electrical
conductors and equipment installed within or on public or

private buildings within the City and providing for the
safeguarding of persons and property from hazards arising
from the use of electricity for light, heating, power,
radio, signaling and other purposes. This Code is
not intended as a design specification nor an instruction
manual for untrained persons.
Section 3.
That three copies of the National Electrical Code, being
considered for adoption by this Ordinance, all certified
to be true copies by the Mayor and City Clerk, shall be on
file with the City Clerk and shall be open for public
inspection in her office at the Aspen City Hall, Aspen,
Colorado, any week day between the hours of 9 a.m. and 5 p.m.
at least fifteen (15) days preceeding the public hearing
on this ordinance.
Section 4.
That on passage of this ordinance, and adoption, of
this Code by reference, one copy of the Code may be kept
in the office of the chief enforcement officer instead
of in the office of the City Clerk. Following the adoption
of this Code, the City Clerk shall at all times maintain
a reasonable supply of copies of the Code available for purchase
by the public.
Section 5.
That existing ordinances or parts of ordinances
covering the same matters as embraced in this ordinance
are hereby repealed and all ordinances or parts of ordinances
inconsistent with the provisions of this ordinance are
hereby repealed, except that this repeal shall not prevent the
prosecution or punishment of any person for any act done

or committed in violation of any ordinance hereby repealed
prior to the taking effect of this ordinance.
Section 6.
If any provision of this ordinance or the application
thereof to any person or circumstance shall be found to
be invalid, such invalidity shall not affect any remaining
portion or application which can be given effect and to this
end this ordinance is declared to be severable.
Section 7.
A public hearing on this ordinance shall be held
on the ~ day of ~~ 1974, at 5 p.m.
in
the City Council Chambers, Aspen City Hall, Aspen,
Colorado. Pursuant to the provisions of Chapter 139
Article 34, C.R.S. 1963, notice of the hearing Shall be
published at least twice, once at least eight (8) days
preceeding and once at least fifteen (15) days preceeding
the hearing above established.
