ORDINANCE NO. 56

AN ORDINANCE MAKING AN EMERGENCY APPROPRIATION
FOR THE PURPOSE OF APPRAISING THE ASPEN ONE
COMPANY PROPERTY TO INITIATE THE CITY OF ASPEN,
ASPEN ONE AND POST OFFICE DEPARTMENT LAND
TRADES
WHEREAS, The Aspen City Council has determined that
to initiate intelligent negotiations with Aspen One and
the United States Postal Service for the proposed land
trade to relocate the post office on the City-owned Rio
Grande Property it is necessary, to protect the public
property, to acquire an independent appraisal of the Aspen
One property, and
WHEREAS, the City Manager has requested of the
Council an emergency appropriation to cover the cost of
the appraisal and has made the request pursuant to the
provision of Section 9.12(b) of the Aspen Charter, and
WHEREAS, the City Council finds the request
appropriate and wishes to grant the same,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1
That it is hereby determined that an emergency
exists requiring an appropriation in the amount of
$ /.~O~L°-~, estimated by Earl R. Baughar, M.A.I. to
be the cost of an appraisal of the value of the Aspen One
Property located adjacent to the Roaring Fork River,
Aspen, Colorado, and that this appropriation is needed to
meet an emergency affecting the public property under
the City Council's stewardship so that it can intelligently
negotiate for the proposed land sale-trade between the
City of Aspen, Aspen One Company and the United States Post
Office.

Section 2
That to effectuate the above there is hereby
appropriated the amount of $ ~-~ ~ pursuant to the
provisions of Section 9.12(b) entitled "Emergency
Appropriations" of the Aspen Home Rule Charter.
Section 3
That if any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions
or applications of the ordinance which can be given effect
without the invalid provisions or applications and to
this end the provisions or applications of this ordinance
are declared to be severable.
Section 4
A public hearing on this ordinance shall be held
pursuant to the requirements of the Aspen Home Rule Charter

p.m., in the City Council Chamber, City Hall, Aspen, Colorado.
