AN ORDINANCE AMENDING SECTION 7-141 OF THE MUNICIPAL CODE
OF THE CITY OF ASPEN RECOGNIZING AS PERMISSIBLE STRUCTURES
WITHIN THE BUILDING CODE MOVABLE UNITS IF THEY ARE LOCATED
NOT LESS THAN TEN (10') FEET FROM OTHER BUILDINGS OR
STRUCTURES IN FIRE ZONES ONE AND TWO AND PROVIDE SANITARY
FACILITIES IN ACCESSORY BUILDINGS OR ESTABLISH ACCESS TO
THE SAME IN NEARBY STRUCTURES
WHEREAS, there have been submitted applications to the
building inspector for permits to locate movable structures
within the City of Aspen for use as restaurants or otherwise,
and
WHEREAS, the Uniform Building Code, adopted by refer-
ence in Ordinance 9, Series of 1974, requires use of fire-
resistive building materials in certain fire zones and incorpor-
ation of sanitary facilities in such structures, and
WHEREAS, the City Council feels such structures may
be an asset to the community, wishes to authorize the same,
and recognize them as, under certain conditions, acceptable
structures for purposes of the Uniform Building Code,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1.
That Section 7-141 of the Municipal Code of the City
of Aspen, Colorado, is hereby amended by the addition of a new
subsection to read as follows:
"(n)
Nothing herein shall prohibit the location of
a movable structure anywhere within the City of
Aspen, provided it shall meet all requirements of
the Building Code, except as hereinafter specifically
provided.

In the event such structure is unable
to meet fire-resistive construction
requirements of the applicable fire
zone, the same shall be deemed satis-
fied by placement of the structure
not less than ten (10') feet from any
other buildings or structures.
In the event such structure is unable
to incorporate the required sanitation
facilities, the owner may demonstrate
compliance with these requirements by
construction of the same in an accessory
building complying with all require-
ments of this Code, or by showing,to the
satisfaction of the building inspector,
that access to such facilities owned
by others is guaranteed."
Section 2.
Nothing herein shall be construed to permit any use or
occupation of movable structures in violation of Chapter 20
("Subdivision"), or Chapter 24 ("Zoning") of the Municipal
Code, or other applicable provisions, nor be deemed an attempt
to modify any health or other police power regulation, but
this ordinance shall be limited in interpretation to only an
amendment to the Uniform Building Cide, 1973 Edition, adopted
by the City Council of the City of Aspen in its Ordinance 9,
Series of 1974.

Section 3.
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions
or applications of this ordinance are declared to be severable.
Section 4.
A public hearing on this ordinance shall be held on the
__ day of , 197__, at 5 P.M. in the City
Council Chambers, Aspen City Hall, Aspen, Colorado.
