AN ORDINANCE AMENDING CHAPTER 13 OF THE ASPEN
MUNICIPAL C(~)E BY ADDING THERETO SECTION 13-42
MAKING IT UNLAWFUL TO INTERCEPT CATV TELEVISION
SIGNALS WITHOUT THE PRIOR AUTHORIZATION OF THE
DISTRIBUTING COMPANY.
WHEREAS~ by Ordinance No. 5 of the Series of 1962~ the
Aspen City Council granted to Canyon Cable TV Corporation the
non-exclusive right to operate and market CATV services within
the City of Aspen; and
WHEREAS~ Canyon Cable TV Corporation pays the City of
Aspen two (2%) per cen~of its annual gross revenues derived
from the sale of television services; and
WHEREAS, it is possible that other cable TV companies
may apply for and be granted similar non-exclusive righ~in
the future, which grants would provide additional revenues
to the City of Aspen; and
WHEREAS, Canyon Cable TV Corporation has advised the Aspen
City Council that a problem exists with persons intercepting
their television signals without the prior authorization of the
Corporation, and that effective machinery for the prosecution of
such activities does not presently exist in the City of Aspen;
and
WHEREAS, the Aspen City Council has determined that such
unauthorized activities reduce the City's revenues, and that it
will be in the best interests of the inhabitants of the City of
Aspen to make such activities illegal,
NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:
Section 1.
That Chapter 13 of the Municipal Code of the City of Aspen

is hereby amended by the addition of a new Section 42, which
said Section 42 shall read as follows:
"Sec. 13-42. Unauthorized interception of
CATV television signals prohibited.
It shall be unlawful for any person to intercept
within the City of Aspen the television signals of any
cable TV company, by means of a connection with the cable
over which such signals are transmitted or otherwise,
without the priOr authorization of the transmitting company."
Section 2.
If any provision of this ordinance or the application thereof
to any perSon or circumstance is held invalid, such invalidity
shall not affect other proviSiOnS or applications of the ordinance
which can be given effect without the invalid provisions or
applicationS, and to this end the provisionS of this ordinance
are declared to be severable.
Section 3.
A public hearing on the ordinance shall be held at
City Hall Building, Aspen, colorado.
