AN ORDINANCE AMENDING SEC 5-30 OF THE ASPEN MUNICIPAL CODE
EXTENDING TO ALL AREAS OF THE CITY OF ASPEN THE DOG LEASH
REQUIREMENTS; DEFINING WHEN A DOG SHALL BE DEEMED RUNNING
AT LARGE; AND DESCRIBING PENALTIES THEREFORE.
WHEREAS, Section S-30 of the Aspen Municipal Code provides
that a dog may not be permitted to run at large within the
Commercial, AR, and Park zoned districts of the City of Aspen,
and
WHEREAS, Section 5-30 provides that a dog shall be deemed
to be running at large when off or away from the~premises of
the owner, possessor or keeper, and not under the direct
control by leash, cord or chain no longer than ten
in length and of sufficient strength to completely

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF APSEN, COLORADO:
Section 1.
That Section 5-30 of

within the limits of the City of Aspen.
(b) A dog shall be deemed to be running at
off or away from the premises of the owner,
or keeper thereof and not under the direct

(c) Any person convicted of violating any provision
of this section shall, upon conviction, be fined in an
amount not to exceed three hundred and 00/100 ($300.00)
dollars, or by imprisonment for not more than ninety
(90) days or by both
Section 2.
If any provision of
such fine and imprisonment.
this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not effect other provisions or applications
of the ordinance which can be given effect without the invalid
provisions or applications, and to this end the provisions or
applications of this ordinance are declared to be severable.

A public hearing on this ordinance
