ORDINANCE NO. 29
(Series of 1973)
ORDINANCE REQUIRING CONTROL OF EMISSIONS FROM RESTAURANT OR
OTHER FOOD PREPARATION FACILITIES BY INCINERATION OR CONDENSING
WITH METHODS APPROVED BY THE CITY SANITARIAN; PROVIDING FOR
EXEMPTIONS FROM SUCH REGULATION; AND PROVIDING THAT ALL REQUIRED
EQUIPMENT HAVE NATIONAL SAFETY FOUNDATION APPROVAL AND BE
INSTALLED BY DECEMBER 31, 1974 OR PRIOR TO COMMENCEMENT OF ANY
NEW RESTAURANT OR FOOD PREPARATION OPERATION, WHICHEVER OCCURS
FIRST.
WHEREAS, the City of Aspen is experiencing Continued

THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ASPEN,
COLORADO:
Section 1.
Effective December 31, 1974, no person shall cause or
permit to cause emissions from restaurant or other food
preparation exhaust systems which have not been controlled
through adequate measures as approved prior to installation
by the City Sanitarian. Adequate measures shall include,
but not be limited to, afterburners, contact condensors and
water scrubbers.
Section 2.
If the nature of the food prepared results in negligible
emissions in the opinion of the City Sanitarian, exemption

from these regulations may be granted by said officer.
Section 3.
Pursuant to Section 1, emissions from restaurants or other
food preparation facilities, if exhausted through an after-
burner as a means of control, shall be subjected to at least
1200 degrees Fahrenheit

shall commence operations after the effective date of this
ordinance, but prior to December 31, 1974, shall install
all equipment required by this ordinance prior to commencing
said operation.
Section 6.
If any provision of this ordinance or the application
thereof to any person or circumstance is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or applications and to this end the provisions or
applications of this ordinance are declared to be severable.
Section 7.
A public hearing on the ordinance shall be held on
Monday, October 29, 1973, at 5 p. m. in the City Council
Chambers, City Hall Building, Aspen, Colorado.
