HomeMy WebLinkAboutordinance.council.040-73RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~0 (Series of 1973) AN ORDINANCE MAKING A SUPPLEMENTAL APPROPRIATION TO THE DEBT SERVICE FUND FOR AGENTS FEES FOR THE CITY OF ASPEN BUDGET YEAR ENDING DECEMBER 31, 1973, AND DECLARING THAT AN EMERGENCY EXISTS REQUIRING IMMEDIATE ENACTMENT. WHEREAS, the City Manager has certified that there are available for appropriation excess revenues allowing the Council to make a supplemental appropriations for the 1973 budget year, and WHEREAS, the City Manager has submitted for consideration a supplemental appropriation in the amount of Eleven Thousand Eight Hundred and Forty-two ($11,842.00) Dollars to the Debt Service Fund to cover the agents fees for issuing the 1973 Sales Tax Revenue Bonds, and WHEREAS, the City Council wishes to authorize this supple- mental appropriation pursuant to section 9.12 (a) of the Aspen Charter and to make the appropriation effective immediately pursuant to section 9.12 (e) of said Charter; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF APSEN, COLORADO: Section 1. That a supplemental appropriation be made to the Debt Service Fund in the amount of Eleven Thousand Eight Hundred Forty-two ($11,842.00) Dollars to be paid from seventh cent sales tax collections and be paid for agents fees incurred in issuing the 1973 Sales Tax Revenue Bends as follows: Debt Service Fund Increase to Revenues Seventh cent sales tax collections $11,842.00 RECORD OF PROCEEDINGS 100 Leaves Increase to Expenditures Agents fees (1973 Sales Tax Revenue Bonds) $11,842.00 Section 2. By reason of the fact that the City must complete appro- priation procedures before the close of the 1973 calendar year, it is hereby declared that an emergency exists and that this ordinance is necessary to the immediate preservation of the public property, health, peace and safety and that it shall be in full force and effect upon final passage and be published within ten (10) days after final passage, or as soon thereafter as possible. Section 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications and to this end the provisions or applications of this ordinance are declared to be severable.
