AN ORDINANCE AMENDING SECTION 6-1-18 OF THE MUNICIPAL CODE OF
THE CITY OF ASPEN, REGULATING AND PROHIBITING THE KEEPING,
STORAGE OR COLLECTION OF JUNK; DECLARING THE SAME TO BE UNLAW-
FUL AND A NUISANCE; PROVIDING EXCEPTIONS THERETO; AND PROVIDING
PENALTIES THEREFORE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO, THAT:
Section 1: Section 18 of Chapter 1, Title VI of The
Municipal Code of the City of Aspen, entitled General Offenses,
is hereby amended to read as follows:
"6-1-18. Keeping of Junk Prohibited. It
shall be unlawful to keep, store, or provide for the
collection of junk within the City and that the keeping,
storage, or collection of junk within the City is hereby
declared to be a nuisance and is detrimental to the
health, safety, convenience and general welfare of the
citizens thereof.
Junk is hereby defined to be any
old, used or secondhand materials of any kind, including,
without limitation, cloth, rags, clothing, paper, rubbish,
bottles, rubber, iron, tires, brass, copper, or other metal,
furniture, refrigerators, freezers, all other appliances,
used motor vehicles or the parts thereof or therefrom,
machines, apparatuses and contrivances, and parts thereof,
which are no longer in use, any used building material,
boards or other lumber, cement blocks, bricks, or brick
bats, or other secondhand building material, or any dis-
carded machinery, tractors, trucks, or automobiles, or
any other article or thing commonly known and classifed
as junk.
The keeping, storage or collection
of junk shall not be deemed unlawful or a nuisance when
and if same is kept, stored or collected in completely
enclosed buildings, and this ordinance shall not apply to

any premises where a licensed motor vehicle dealer or a
farm implement dealer conducts his or their business.
The keeping or storage of any motor vehicle
not having thereon a valid and unexpired certificate of
inspection as required by the laws of the State of Colorado,
on private property by any person not specifically exempted
under this ordinance, shall be prima facie evidence of
violation of this ordinance.
It shall be unlawful for any person to violate
any provision of this ordinance, and any person found guilty
of violating any provision of this ordinance shall be
punished for each violation by a fine of not more than
Three Hundred ($300.00) Dollars or by imprisonment for
not more than ninety (90) days, or by both such fine and
imprisonment; further, each act or omission in violation
of one or more than one of the provisions hereof shall be
deemed a separate violation of such provision, and for each
calendar day during which any violation continues, a sep-
arate violation shall be deemed to have been committed."
Section 2. If any provision of this Ordinance or the
application thereof to any person or circumstances is held invalid,
such invalidity shall not affect other provisions or applications
of the Ordinance which can be given effect without the invalid pro-
visions or application and to this end the provisions of this
Ordinance are declared to be severable.
Section 3. A public hearing on the Ordinance shall be
held at ~~/_ ~ /f ?/ at ~7,~P.M. , in the
City Council ~ambers, City Hall, Aspen, Colorado.
Section 4. Ail Ordinances or parts of Ordinances in con-
flict herewith are hereby repealed.
