HomeMy WebLinkAboutordinance.council.033-71RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 3~ (Series of 1971) AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE CITY OF ASPEN, COLORADO FOR THE PURPOSE OF PROVIDING A SYSTEM OF TRAFFIC REGULATIONS CONSISTENT WITH STATE LAW AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGHOUT THE STATE AND THE NATION; ADOPTING BY REFERENCE THE 1971 EDITION OF THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES;" TOGETHER WITH AMENDMENTS THERETO; REPEALING ALL ORDINANCES IN CON- FLICE THEREWITH; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. Adoption. -- Pursuant to Chapter 139, Article 34, C.R.S. 1963 as amended, there is hereby adopted by reference Sections 1 to 26, inclusive, of the "Model Traffic Code for Colorado Municipalities," officially approv- ed, adopted, and published in 1971 as such by the State Department of Highways, Denver, Colorado, and hereinafter referred to as the "Municipal Traffic Code" of which three (3) copies are now filed in the office of the Clerk of the City of Aspen, Colorado and may be inspected during regular bus- iness hours, the same being adopted as if set out at length. Section 2. Additions or Modifications: -- The said adopted Code is subject to the following additions and modifications: Model Traffic Code Section 10-2 is hereby amended to read as follows: Section 10-2. Obedience to angle-parking signs or markings. --On those streets which have been approved and signed or marked for angle parking, no person shall stop, stand or park a vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings; and such vehicle shall be so parked with i~ front ~ wheel no more than six (6) inches from the curb. (3) Within two (2) feet of a walk- way leading to a residence where no sidewalk exists. Section 3. Penalties. -- The following penalties, herewith set forth in full, shall apply to this ordinance. (a) It is unlawful for any person to violate any of the provisions stated or adopted in this ordinance. (b) Every person convicted of a violation of any provision stated or adopted in this ordinance shall be punished by a fine not exceeding three hundred ($300.00) dollars, or by imprisonment not exceeding ninety (90) days, or by both such fine and imprison- ment. Section 4. Application -- This ordinance shall apply to every street, alley, sidewalk area, driveway, park, and to every other public way or public parking area, either within or outside the corporate limits of this municipality, the use of which this municipality has jurisdiction and authority to regulate. The provisions of Sections 5-1, 5-2, 15-12 and 23-3 of the adopted Model Traffic Code respectively concerning careless driving, reckless driving, unauthorized devices, and accident investigation shall and ways but also throughout Section 5. Validity. apply not only to public places this municipality. -- If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts thereof, irrespec- tive of the fact that any one part or parts be declared invalid. Section 6. Repeal -- Existing ordinances or parts of -2- RECORD OF PROCEEDINGS 100 Leaves ordinances covering the same matters as embraced in this ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 7. Interpretation. -- This ordinance shall be so interpreted and construed as to effectuate its general pur- pose to make uniform the local traffic regulations contained herein. Article and section headings of the ordinance and adopted Model Traffic Code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or extent of the provisions of any article or section thereof. Section 8. Short Title. -- This ordinance may be known and cited as the Municipal Traffic Ordinance. Section 9. Publication. -- The City Clerk shall certify to the passage of this ordinance, cause notice of its contents and passage to be published or posted, and make not less than three (3) copies of the adopted Code available for inspection by the public during regular business hours. Section 10. Public Hearing. -- A public hearing on the ordinance shall be held on the 10th day of January, 1972, at 5 P.M. in the City Council Chambers, City Hall, Aspen, Colorado. Section 11. Effective Date. -- This ordinance shall take effect from and after the 15th day of January, 1972. MAYOR //~ ATTEST: ~ CITY CLERK -4- RECORD OF PROCEEDINGS 100 Leaves NOTICE OF HEARING NOTICE is hereby given of a public hearing before the City Council of the City of Aspen, Colorado, at 5 P.M. on the 10th day of January, 1972, at the City Council Chambers, City Hall for the purpose of considering the adoption by reference of the "Model Traffic Code for Colorado Municipalities," 1971 edition, as the traffic ordinance of the City of Aspen, Colorado. This ordinance may be known and cited as the "Municipal Traffic Ordinance." Copies of the model Code are on file at the office of the City Clerk and may be inspected during regular business hours. If enacted as an ordinance of this City, the model Code will not be published in full= but in accordance with State law, copies will be kept on file and also made available for distri- bution and sale to the public. The 1971 "Model Traffic Code for Colorado Municipalities," is published by the State Department of Highways, 4201 East Arkansas Avenue, Denver, Colorado 80222. The subject matter of the Municipal Traffic Code, relates primarily to comprehensive traffic control regulations for the City. The purpose of the Ordinance and the Code adopted therein is to provide a system of traffic regulations consistent with State law and generally conforming to similar regulations throughout the State and the nation. At its next regular meeting following this hearing, the City Council will consider passage of the adopting Ordi- nance. This notice given and published by order of the Council of said City of Aspen.
