AN ORDINANCE AMENDING CHAPTER 1 OF TITLE 2 ENTITLED CITY PLANNING
COMMISSION PERTAINING TO THE NUMBER OF MEMBERS, QUALIFICATIONS OF
MEMBERSHIP, TERMS OF OFFICE AND POWERS AND DUTIES OF THE COMMISSION;
AND HEREBY DECLARING AN EMERGENCY TO EXIST.
BE IT ORDAINED by the City Council of the City of
Aspen, Colorado:
WHEREAS, the City Council of the City of Aspen has
established a Planning Commission under, and in accordance with,
the Statutes of the State of Colorado to meet and satisfy the
purposes set out in Colorado Revised Statutes 1963, 39-59-7; and,
WHEREAS, it is necessary to re-establish the terms
and qualifications of membership in the Planning Commission in
conformity with the Home Rule Charter for the City of Aspen
recently adopted.
Section 1: Section 1, Chapter 1 of Title 2 of the
Official Code of the City of Aspen is hereby amended to read
as follows:
"2-1-1: MEMBERS;QUALIFICATIONS;TERM OF OFFICE:
A City Planning Commission is hereby
established which shall consist of seven (7) members who shall be
appointed by the City Council to serve overlapping terms of four (4)
years each, except one member shall serve for a term of two (2) years.
Of the seven (7) members initially appointed by the City Council,
four ~) members shall serve until the first regular meeting in July
of 1971 and three (3) members shall serve until the first regular
meeting in July of 1973. Thereafter each member shall be appointed
to serve for a term of four (4) years, except one member shall be
appointed to serve for a term of two (2) years. Ail members shall
serve at the pleasure of the City Council and may be removed by a
majority vote of the whole City Council.
Ail of such members shall have been
residents of the City of Aspen for at least two (2) years and shall
be qualified electors, and no member of the City Council, the Mayor,
and City employee, nor any appointed city official shall serve on
the City Planning Commission. Vacancies shall be filled for the
remainder of the unexpired term by appointment of the City Council.
Public notice of such vacancy shall be made. There shall be no
restraint upon the number of terms any member of the Commission
may serve."

The City Planning Commission shall
have such duties and powers relating to Planning and Zoning
as shall be conferred upon it by the statutes of the State of
Colorado and by this Code."
Section 3: As a result of the recent adoption of
the Home Rule Charter the membership of the City Planning
Commission has been reduced to less than a quorum, and in the
opinion of the City Council this ordinance is necessary for
the immediate preservation and protection of the public health,
safety, convenience and general welfare, and it is enacted for
that purpose declaring an emergency to exist.
