AN ORDINANCE REPEALING, REENACTING WITH AMENDMENTS,
CHAPTER 7, TITLE VI OF THE OFFICIAL CODE OF THE CITY
OF ASPEN PROHIBITING THE SALE AND USE OF FIREWORKS,
WITH THE EXCEPTION OF MODEL ROCKETS IN CERTAIN AREAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, THAT:
Section 1: Chapter 7, Title VI of the Official
Code of Aspen, entitled "Fireworks" is hereby repealed,
and reinacted with amendments, to read:

6-7-1 DEFINITIONS:
The term "fireworks"
means and includes any article, device or substance
prepared for the primary purpose of producing a visual
or auditory sensation by combustion, explosion, de-
flagration, or detonation, including, without limitation,
the following articles and devices commonly known and
used as fireworks: Toy cannons or toy canes in which
explosives are used, blank cartridges, the type of
balloon which requires fire underneath to propel the
same, firecrackers, torpedoes, skyrockets, roman
candles, daygo bombs, sparklers, and torches, and the
devices for discharging same; PROVIDED, this definition
shall not include ammunition and firearms or dynamite
and devices for exploding the same.
6-7-2 REGULATION OF SALE:
The sale, possession
or display for sale of fireworks as herein defined,
within the City of Aspen, Colorado, is unlawful.

6-7-3 DISCHARGE REGb-LATED:
It shall be unlawful for
any person to set off or discharge fireworks of any
kind within the City of Aspen, Colorado, except with
permission of the City Manager for supervised public
display of fireworks.
6-7-4 CONSTRUCTION:
This ordinance shall not
be construed to prohibit any person who sells or uses
model rockets as hereinafter described, and any person
engaged in manufacturing of model rockets or model
rocket engines who offers for sale, exposes for sale,
or has in his possession with intent to offer for
sale or sell, model rocket engines, or model or
educational rockets which utilize a replaceable engine
or motorcartridge, of non-metallic construction, con-
taining less than two ounces of propellant, and
designed to be launched by an electrical ignition
system and contain a parachute or other means for
safe recovery of the rocket vehicle, except no model
rockets shall be used or discharged within the C-i,
C-2 or C-C commercial zoned areas of the city."
Section 2: If any provision of this ordinance
or the application thereof to any person or circumstances
is held invalid, such invalidity shall not affect other
provisions or applications of the ordinance which can
be given effect without the invalid provisions or
application, and to this end the provisions of this
ordinance are declared to be severable.
Section 3: A public hearing on the ordinance
