ORDINANCE NO. ~/
(SERIES OF 1968)
AN ORDINANCE AMENDING TITLE XI OF THE ZONING CODE OF THE CITY
OF ASPEN RELATING TO USES-PERMITTED, USES-CONDITIONAL AND
USES-NOT pERMITTED IN C-2 COMMERCIAL DISTRICT AND DECLARING
AN EMERGENCY TO EXIST.
BE IT ORDAINED by the City Council of the City
of Aspen, Colorado;
Section 1: Subsection (c) of Section 7 of Chapter 1
is hereby amended to read as follows:
"Uses - Permitted
1. Any permitted use of the AR-1 Accommodations Re-
creation district, except patio houses, and of the C-1 Com-
mercial district; subject to all use, lot area and yard re-
quirements of those districts regulations unless other-
wise specified below;
2. Any general retail or service commercial use in-
cluding the following and similar uses; vehicle and equip-
ment rental, sales, storage and repair;
3. Limited industrial uses including the following
and similar uses; builders supply and lumber yard, contrac-
tor's yard, dry-cleaning plant and laundry, fabrication
and repair of building materials and components, manu-
facture and repair of sporting goods, printing and pub-
lishing plants, transportation depot, warehousing and
storage, shop-craft industry, provided no unusual traffic
hazard, noise, dust, fumes, odors, smoke, vapor, vibration,
glare or industrial waste disposal problem will be created
thereby.
4. Recreation and entertainment establishment.
Uses- Conditional
5. Any conditional use of the AR-1 Accommodations
Recreation district and of the C-1 Commercial district,
subject to all use, lot area and yard requirements of
that district unless specified below;
6. Drive-in restaurants, gasoline service stations,
automobile washing facilities and any limited industrial
use listed under paragraph 3 of permitted uses above which
may create unusual traffic hazards, noise, dust, fumes,
odors, smoke, vapor, vibration, glare or industrial waste
disposal problems subject to approval of Board of Adjust-
ment provided the following limitations are placed on all
such uses:
(a) Ail uses-conditional approved by Board of
Adjustment shall be operated within an enclosed structure.

(b) Noise, dust, fumes, odors, smoke, vapor,
vibration, glare or waste shall be confined to the
lot upon which the use is permitted.
(c) Outdoor storage, equipment and refuse areas
shall be concealed from view of abutting rights-of-way
and adjoining residential districts.
Uses - Not Permitted
7. Alfalfa dehydration plant; automobile wrecking
yards; concrete batch plants; concrete block plants;
cinder block plants, pre-stressed concrete plants, pre-
cast concrete plants; asphalt,lime, gypsum or plaster
of paris manufacturing; slaughter houses; commercial
hog ranches; livestock of poultry feed yards; acid
manufacturing; fat rendering or distillation of bones;
petroleum refining; mining or smelting of ore; garbage,
offal or dead animal reduction or dumping; stock yards;
above ground storage of flammable liquids or gases;
livery stables or livestock auctions; and such other
similar uses."
Section 2: Because of the matters and things herein-
above set forth, the City Council of the City of Aspen, Colorado
hereby finds, determines and declares that an emergency exists
and that this Ordinance is necessary for the immediate preserva-
tion of the public peace, health and safety.

law by the City Council of Aspen, Colorado at its regular
