AN ORDINANCE AMENDING TITLE XI, CHAPTER 1, SECTION 5 AND
SECTION 6, REQUIRING NO LESS THAN 10 FEET OF SPACE t~TWEEN
ANY ACCESSORY AND PRINCIPAL BUILDINGS IN R-40, R-15, R-6,
AR-1 AND AR-2 ZONES.
WHEREAS, the City Council of the City of Aspen,
Colorado, upon recommendation of the Planning and Zoning
Commission, and a Public Hearing having been held, believes
it to be in the best interest of and purposes of zoning
to require a minimum distance between accessory and princi-
pal buildings.
BE IT ORDAINED by the City Council of the City of
Aspen, Colorado:
Section 1: Subsection (a), (b), (c) and (e) of
Section 5, Chapter 1, Title XI, and Subsections (a) and (b)
of Section 6, Chapter 1, Title XI each be amended to read
as follows:
"11-1-5 (a) , (b) , (c) & (e) &
11-1-6 (a) & (b): Distance Between Buildings - No
accessory building shall be constructed within ten (10) feet
from a primary building or dwelling."
INTRODUCED, READ AND ORDERED published as provided
by law by the City Council of Aspen, Colorado. at its regular
meeting held at the City of Aspen on the ~day of September,

26 relating to members, qualifications,
and terms of office of the Planning and Zoning Commission for
the City of Aspen, initiated by petition, is hereby disapproved
and vetoed for the following reasons and objections:
The Colorado Statutes provide that unless otherwise
provided by ordinance the membership and terms of members
shall be as outlined in the Statutes. Our City Code until
recently provided that the membership and the terms of
members would be as follows.
"A City Planning Commission is hereby established,
which shall consist of seven members as follows:
(a) The Mayor of the City, who shall hold office for
the term of his election as Mayor.
(b) A member of the City Council selected by the
Council, who shall hold office for the term of his election
as alderman.
(c) One member, who shall not be an administrative
official or employee of the City of Aspen, appointed by
the Mayor to hold office for the term of office of the Mayor.
(d) Four members, who shall hold office for the term
of six years, except that the respective terms of one third
first appointed shall be two years, one third shall be four
years and one third shall be six years.
Ail of such members shall be resident in the City of
Aspen. Upon the expiration of the terms of office above
stated, the City Council shall appoint their successors who
shall serve for a term of six years or until their successors
are duly appointed and qualified. There shall be no restraint
upon the number of terms any member may serve."
After reviewing the history of the Aspen Planning and Zoning
Commission as relates to its efficiency and effectiveness
as well as the average tenure of the members it was apparent
to me and the majority of Council that the Planning and
Zoning Commission was neither very efficient nor effective.
In a recent compilation of the results of a citizens'
questionnaire the citizens were asked to rate the level of
service and work of various city departments and commissions.
The results show that 39% answered good or excellent which
was the lowest percentage of all departments. 25% answered
poor which was the highest percentage answered that way of
all departments.
The average tenure of al~ appointed Planning and Zoning
members since the formation of the Commission in 1955 is
2~ years,
Based on these facts, by majority vote of the City Council/
an ordinance was passed amending the City Code to provide
that the appointment of Planning and Zoning members would
be for 2 year staggered terms which would allow the duly
elected Mayor and Council to have, by way of these appoint-
ments, a more cooperative and efficient Planning and Zoning
Commission.
