AN ORDINANCE AMENDING TITLE VIII, CHAPTER 1, OF THE ORDINANCES
OF THE CITY OF ASPEN, COLORADO, PERTAINING TO PUBLIC WAYS AND
pROPERTY, AND DECLARING AN EI~ERGENCY TO EXIST.
BE IT ORDAINED by the city Council of the City of Aspen,
Colorado:

of Aspen, Colorado, is hereby re-enacted in its entirety as

provided that in the event that weather conditions prevent such

(C) Accommodations and Recreation Districts AR-i, AR-2:

(D) Residential Districts R-40, R-30, R-15, R-PC, R-6, RMF:
sidewalks shall be 4 feet in width, and shall be set wit,h, the
outside edge 2 feet into the right-of-way of the street.
Section 2: The official Code of the City of Aspen, Colorado
is hereby amended by adding a Section 8-1-13, to read as follows:

Section 3: The official code of the city of Aspen, colorado,
is hereby amended by adding a Section ~o be numbered 8-1-14, to
read as follows:
CURB CUTS

(A) Ail curb cuts shall be approved by the City

(B) Driveways shall be constructed for their full width
from curb to property line and shall be for ingress to and
egress from private property.
(C) No curb cut shall be located closer than twenty-five
(25) feet to an intersection.
(d) The number and width of curb cuts for the different
districts shall be as follows:
(1) Residential Districts R-40, R-30, R-15, R-PC,
R-6, RMF
One curb cut for parcels sixty (60) feet or under
in width.
Two curb cuts for a parcel over sixty (60) feet
in width.
Driveway and curb cut widths shall be twelve (12)
feet for a single garage, and eighteen (18) feet for
a double garage at the widest part of said driveway or
curb cut.
(2) Accomodations & Recreation Districts AR-1 and AR-2
Each parcel of land is allowed one twenty (20)
foot driveway or curb cut or two (2) twelve (12) foot
wide driveways and curb cuts. There shall be a maxi-
mum number of two (2) curb cuts per individual parcel of
land. The minimum distance between two curb cuts on an
individual parcel of land shall be twenty (20) feet.
(3) Commercial Districts C-1 and C-2
One twelve (12) foot curb cut per parcel of land.
Automobile Service Stations - two (2) twenty (20)
foot curb cuts, which may be located one on each street
if station is on a corner.
(E) Curb cuts shall be allowed in districts AR-1 and AR-2 in
excess of twenty (20) feet in width so as to allow access to off-
street parking areas, providing that the following conditions are
met:
(1) The off-street parking spaces provided will not ob-
struct the sidewalk area.
(2) The number of off-street parking spaces provided
is at least as great in number as would be available
in the absence of such enlarged curb cut.
(3) The minimum number of parking spaces specified in
Subsection (2) above are made available for public park-
ing without restriction thereon.
(4) The provisions of the ordinances of the City of Aspen
regarding paving and maintenance of off-street parking
spaces are complied with; and
(5) The property subject to such curb cut is not located
on a state highway within the city limits of the City of
Aspen.

(F) Driveway slabs shall have a minimum thickness of
six (6) inches. When driveways are to cross existing
sidewalks, the sidewalk slabs shall be removed and
driveway slabs constructed all of the way back to the
property line."
Section 4: The official Code of the city of Aspen,
Colorado, is hereby amended by adding a Section 8-1-15, to
read as follows:
"8-1-15 Unusual Conditions: Under unusual conditions of
toPoGraphy, drainage, existing t~ees on ~Y right-o~-
wa~,-existing buildings on private properuy, or special
use requirementS for the property, a variance from the
above requirements may be given by the city Council,
upon filing a written application and a plot plan show-
ing the building site and the special conditions exist-
ing thereon.
Section~5: Because of the matters and things herein-
above set forth, the City council of the City of Aspen, Colo-
rado hereby finds, determines and declares that an emergency
exists, and that this ordinance is necessary for the immediate
preservation of the public peace, health and safety.
