AN ORDINANCE AMENDING CHAPTER 12, TITLE 1, OF THE OFFICY~L CODE
OF THE CITY OF ASPEN, COLORADO, PERTAINING TO THE CITY ATTORNEY,
AND DECLARING AN ~WAERGENCY TO EXIST.
BE IT ORDAINED by the City Council Rf the City of Aspen,
Colorado:
Section 1: Chapter 12, Title 1, of the official code of
the City of Aspen is hereby re-enacted in its entirety to read
as follows:

1-12-1 APPOINTMENT:
The City Council shall
appoint a city attorney whose appointment shall commence on the
first Monday after the first Tuesday in January following the
regular city election or until his successo% is duly appointed
and qualified.

DUTIES:
The City Attorney shall
(a) He shall act as legal
advisor to, and be attorney and counsel for, the Council and shall
be responsible solely to the Council. He shall advise any officer
or department head of the City in matters relating to his official~
when so requested by the City Council and shall file with the ~lerk
a copy of all written opinions given by him.
(b) He shall prosecute
ordinance violations and he shall conduct for the City casesiin
City Magistrates court. He shall file with the Clerk copies of
such records and files relating thereto.
(c) He shall prepare or
review all ordinances, contracts, bonds and other written instru-
ments which are submitted to him by the Council and shall promptly
give his opinion as to the legal consequences thereof.
(d) He shall call to the
attention of the Council all matters of law, and changes or develop-
ments therein, affecting the City.

(e) He shall perform such
other duties as may be prescribed for him by the Council.
(f) Upon the recon~nendation
of the Attorney, or upon its own initiative, the Council may retain
special legal counsel to handle any matter in which the City has
an interest, or to assist and counsel with the Attorney.
1-12-3 COMPENSATION:
For the services specified
above, the City Attorney shall receive as compensation the sum
of five hundred ($500.00) dollars per month. All extraordinary
duties performed shall be authorized by Council and paid for at
the rate of twenty dollars ($20.00) per hour.
Section 2: Because of the matters and things hereinabove
set forth, the City Council of the City of Aspen, Colorado, hereby
finds, determines and declares that an emergency exists, and that
this ordinance is necessary for the immediate pmeservation of the
public peace, health and safety.
