HomeMy WebLinkAboutordinance.council.014-66RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. 14 (Series of 1966) AN ORDINANCE AMENDING TITLE XI, CHAPTER 1, OF THE ORDINANCE OF THE CITY OF ASPEN, cOLORADO, PERTAINING TO ZONING, AND DECLARING AN EMERGENCY TO EXIST. BE IT ORDAINED by the City council of the city of Aspen, Colorado: Section 1: The following sections of Title XI, Chapter 1, of the official Code of the city of Aspen, Colorado, are hereby re- pealed: "11-1-4 (h); 11-1-5 (h); 11-1-6 (h); and 11-1-8 (h)." Section 2: Title XI, Chapter 1, of the official code of the City of Aspen, colorado, is hereby amended by adding a section, to be numbered 11-1-17, which section reads as follows: OFF STREET PARKING: "11-1-17: .... = ~-se requirements that · he ln~en~ o~ ~.~ . = (A} It. ts t=__=~es be provided off the street adequate parking ~u~ ~ for each use of land within the City. Requirements are intended to be based on the demand created by each use. These requirements shall apply to all uses in all districts, off street parking spaces will be re- quired as follows: USE CATEC4DRIES: One Family Dwelling Two Family Dwelling SPACES p~QUIRED: One space per dwelling One space per dwelling unit Dwelling, Multiple Family Boarding or Rooming House One space per dwelling unit One space per 200 square feet devoted to guestS, plus one space for each included dwelling One space per 200 square Dormitory feet RECORD OF PROCEEDINGS 100 Leaves "11-1-17: USE CATEGORIES: Motel, Hotel, Lodge -2- SPACES REQUIRED: Two spaces per three units, and for any increment of less than 3 units, one space shall be pro- vided for each unit Assembly Areas: (Only area used by public shall be con- sidered in determining area.) Intensive Uses: Bowling Alley (Assembly area only) Churches, chapels, Auditoriums, Theatre, Dance Floors (including Room or Hall) Lodge Room or Hall Stadium (Bleacher area only) Swimming Pool (including deck area} Less Intensive Uses: Conference Rooms Dining Rooms Drinking Rooms, Bar Rooms Exhibit Rooms, Gymnasiums Lounges, Skating Rinks Golf Courses Tennis Courts One space per 250 square feet One space per 500 square feet Two spaces per hole Three spaces per court offices: Intensive Uses: Medical and Dental (including clinics) Banks, Loan Companies City, County Less Intensive Uses: One space per 1000 square feet Two spaces per 1000 square feet Utility Companies Telephone, Telegraph Professional (excluding Medical & Dental) General offices RECORD OF PROCEEDINGS 100 Leaves -3- "11-1-17 .' USE ~ATEGORIES: SPACES REQUIRED: Retail: Intensive Uses: Grocery, Drug, Liquor, Variety, Depar.t~.ent, Hardware, Clothing, Sports, Gift, Photography Supply, Radio, Phonograph, Art Supply, Auto Parts & Accessories One and one-half spaces per 1000 square feet Retail: Less Intensive Use~: One-half space per 1000 square feet Furniture, Household Appliances, Building Materials, Lumber, Art ~alle~y, De~orator . studios ~lncludlng Art, Ceramic, Jeweler, sculptor, & similar) Vehicle & Machinery (Sales only) Service Use~: Car Rentals, Auto & Truck Sales & Service Facilities One space for each vehicle, exclusive of service and repair area, which shall meet requirementS of Vehicle Repair Facilities as outlined elsewhere in the ordinance Gas Stations and Vehicle Repair Facilities Laundromat Gasoline pumps - one space per pump Grease Racks - two spaces per rack Wash Racks two spaces per rack Repair Area - one space per 200 square feet (area usable for repair work, exclusive of drives, equipment, storage, utilities, etc.) One and one-half spaces per 1000 square feet RECORD OF PROCEEDINGS 100 Leaves -4- "11-1-17: USE CATEGORIES.: Service Use[: Hospitals, Schools ~ndustrial uses: SPACES REQUIRED: Spaces shall be provided to satisfy the occupancy characteristics on the same site. The deter- mination of requirements shall be the function of the Planning commission using surveys of similar situations and their own judgment One-half space per 1000 square feet of developed site area (B) Uses Not Specifically Enumerated.- Any ~e not listed above shall provide parking in the same ra=~o as the use listed above most nearly approximating the char- acteristics of the unlisted use, according t° the judg- ment of the City Planning Commission. (C) ~on-Conformin~ Uses - Existing non-conforming uses relating to parking shall not be expanded or chan~ed to a more intensive use unless the increment of expansion in the entire area changed to a more intensive use can be developed to meet requirements of this ordinance. (D) Location - Parking required for any use must be located in the same zone district as the use. (Parking for any dwelling, hospital or school must be located on the same building premises and be in the same ownership as the principal use. Parking for a boarding or rooming house, lodge, motel or hotel or dormitory must be located on the same or on adjacent premises and be in the same ownership as the premises occupied by the principal use.) (E) Characteristics - (1) Each off-street parking space shall have an unobstructed area measuring not less than nine feet wide by eighteen feet long and feet high, and a permanent right-of-way seven -= including adequate sPace for ingress or easemen~ and egress for vehicular access to a street or alley. In the event that movement of automobiles is necessary to provide access to parking spaces, an attendant must be on duty during all business hours for institutional or assemably use, and shall be on duty continuously in accommodation or residential uses. RECORD OF PROCEEDINGS 100 Leaves -5- "11-1-17: (2) Off-street parking spaces must be paved with an all weather surface, and must be maintained in an accessible and usable condition at all times. The use of such spaces shall not at any time be obstructed by vehicles, equipment or merchandise offered for rent or sale." Section 3: ordinance No. 6, Series of 1966, is hereby re- pealed. Section 4: Because of the matters and things hereinabove set forth, the City Council of the City of Aspen, Colorado, hereby finds, determines and declares that an emergency exists, and that this ordinanee is necessary for the immediate preservation of the public peace, health and safety.
