RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 1966) AN ORDINANCE AMENDING TITLE X, cHAPTER 1, OF THE ORDINANCES OF THE CITY OF ASPEN, COLORADO, PERTAINING TO TRAFFIC, AND DECLARING AN EMERGENCY TO EXIST. BE IT ORDAINED by the city Council of the City of Aspen, Colorado: Section 1: Section 10-1-1, of Chapter 1, Title X, of the official code of the City of Aspen, colorado, is hereby re-enacted in its entirety, to read as follows: ADOPTION OF MODEL TRAFFIC CODE: "10-1-1: vehicular and pedestrian traffic within the City of Aspen, the establishment of rules and regu- lations for the issuing of permits, and the fixing of penalties shall be regulated in accordance with the Model Traffic code for colorado Municipalities, 1966 Edition, three copies of which shall be on file in the office of the City Clerk and may be inspected during regular business hours, the same being hereby referre9 to, adopted, and made a part hereof as if fully set forth here~n in full, pursuant to the authority conferred by the Laws of the State of Colorado; provided, however, the following portions of such Model Traffic code are not adopted and are expressly deleted: (1) Section 17-1 (2) Section 17-2 (3) Section 17-3 (4) Section 17-4 (5) Section 17-5 (6) Section 17-7 (7) Section 17-8 (8) Section 21-5 Effect of Regulations License Required License Application issuance of License Attachment of License Plate Transfer of Ownership Rental Agencies Restricted Use of skies, toboggans, coasters, roller skates and similar devices amended, Section ~: ~ection 10-1-3, to read as follows: of Chapter 1, Title X, is hereby AMENDED sECTIONS: "10-1-3: The following sections of the .... 1966 Edition" "Model Traffic code for Colorado Munxc~pal~tles, are hereby amended to read as follows: RECORD OF PROCEEDINGS 100 Leaves "10-1-3: A. Section 4-1 - State speed laws applicable: The state traffic laws regulating the speed of ve1~ic~e~ shall be applicable upon all streets within this munici- pality, except as changed by ordinance, inow~ich ev~t appropriate speed limit signs shall be used aesigna~ng such changes, and it shall be prima facie unlawful for any person to drive a vehicle at a speed in excess of any such speed limits. i nsB ~ ~0 ~pon© n in ~a ~r s r t c een ~i~ned or marke~ 'for angle parkxng, no person shall stop, stand or park a Vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings, and when so parking shall only park on the right hand side of the street. C. Section 16-7 - Pedestrian to walk on left side of roadwa~ where sidewalks are not provided; not to Solicit rides: 1. Pedestrians walking along a street or roadway where sidewalks are not provided shall walk on the extreme left side of the street or roadway facing approaching traffic. 2. No person shall solicit a ride or at- tempt to solicit a ride from the driver of any private vehicle. 3. Part 1 of this Section, applying to pedestrians, shall also be applicable to riders of animals. D. Section 20-4 - clinging to Vehicles: Any person ri~ng upon any bicycle, motorcycle, motor- driven cycle, coaster, sled, skis, roller skates, or any toy vehicle shall not attach the same or him- self to any vehicle upon any street, except with permission of the chief of police." Section 3: Every person found guilty of a violation of any provision of this ordinance may be punished by a fine of not more than $300.00 or by imprisonment for not more than ninety (90) days. Section 4: Ail former traffic ordinances of this municipality in conflict with this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. RECORD OF PROCEEDINGS 100 Leaves -3- Section 5: (A) As to traffic violations specified below, they may be handled in the following manner: In cases where there has been no collision and no injury to person or property, and at the discretion of the arresting officer, a notice in the form of a penalty assessment may be given at the time of the arrest to the person arrested, if such person elects forthwith at the time of such arrest to accept and agrees to pay such penalty assessment in lieu of further proceedings or defense of such violation in court. Such penalty assessment, in the amount specified be- low, must be paid at the Police Department in person or by registered mail within five (5) days from the date of the arrest. (B) If such penalty assessment be not so paid, said violator shall be proceeded against as by law provided for the violation of the applicable traffic ordinances, and said violator shall be subject to all fines, jail sentences or other penalties set forth in the ordinances when said violator is found guilty of a violation by the Municipal Court. (C) The Notice of Penalty Assessment shall be con- strued to be a Sua~ons for a charge of violation under said ordinances in the event the violator fails or refuses to pay the penalty assessment within five (5) days from the date of arrest, and such notice shall be in such form as prescribed by law so as to show the nature of the charge and the court in which said charge shall be heard. In the event the penalty assessment prescribed herein is not paid, then the prosecution as for a violation of said ordinance shall be thereafter heard in such court. In the event that a prosecution shall be had hereunder, the violator shall be privileged to answer the charge made against him in the manner and within the time and subject to the other provisions of said ordinance relating to prosecution of violation thereof.
