ORDINANCE NO. 24
(Series of 1966)
AN ORDINANCE AMENDING TITLE VI, CHAPTER 1, OF THE ORDINANCES OF
THE CITY OF ASPEN, COLORADO, PERTAINING TO POLICE REGULATIONS,
AND DECLARING AN EMERGENCY TO EXIST.
BE IT ORDAINED by the City Council of the City of
Aspen, Colorado:
Section 1: Chapter 1, Title VI, of the Official Code
of the City of Aspen, Colorado, is hereby amended by adding a
section to be numbered 6-1-43, to read as follows:
"6-1-43: TRANSIENT SALES:
(A) The practice of being in and upon
private residences in the CitY of Aspen, Colo-
rado, by solicitors, peddlers, hawkers, itin-
erant merchants, and transient vendors of mer-
chandise, not having been requested or invited
so to do by the owner or owners, occupant or
occupants of said private residences, for the
purpose of soliciting orders for the sale of
goods, wares, and merchandise, and/or for the
purpose of disposing of and/or peddling or
hawking the same, Subject to the exceptions
stated below, is hereby declared to be a
nuisance, and punishable as a misdemeanor.
(B) Section (A) above shall not be ap-
plicable to persons representing charitable,
recreational, or civic enterprises.
(C) The Police of the City of Aspen are
hereby required and directed to suppress and
abate any such nuisance as is described above.
(D) Any person convicted of perpetrating
a nuisance, as described above, upon conviction
thereof, shall be fined a sum not more than
three hundred ($300.00) dollars ~/or not more
than ninety (90) days imprisonment in the
County Jail."
Section 2: Because of the matters and things herein-
above set forth, the City Council of the City of Aspen, Colorado,
hereby finds, determines and declares that an emergency exists,
and that this ordinance is necessary for the immediate preser-
vation of the public peace, health, and safety.
