AN ORDINANCE AMENDING TITLE III, CHAPTER 3, OF THE ORDINANCES OF THE
CITY OF ASPEN, COLORADO, PERTAINING TO WATER DEPARTMENT, AND DECLAR-
ING AN EMERGENCY TO EXIST
BE IT ORDAINED by the City Council of the City of
Aspen, Colorado:
Section 1: Section 3-3-6, subsection (b), of Chapter 3,
Title III, of the official Code of the city of Aspen, colorado, is
hereby re-enacted in its entirety to read as follows:
(b) Charges and assessments for the use of water from
the water mains of the city of Aspen, Colorado,
within and without such City, shall be imposed by
the Manager, as follows:
(1) For Residence, dwelling house, or apartment purposes where
the consumer has not installed a meter, the rate of charge ~or each
calendar month, or any fraction thereof (known as the flat rate)
shall be as follows:

(2) The use of water for one day or any fraction thereof in any
calendar month shall be deemed use of water for the full calendar
month for the purposes of the above schedules. Should the Manager deter-
mine that the flat rate for residential purposes hereinabove prescribed
would be greater than the minimum rate herein prescribed for the
period indicated, the flat rate hereinbefore prescribed shall apply for
the period of use. The rates herein prescribed shall not apply
unless the consumer has requested of the Manager a disconnect of ser-
vice for the period of non-use.
(3) For Residential purposes where the consumer has installed a
meter, th~rate or charge for such calendar month, or any fraction

(5) Flat rates are available to all commercial users of water,
including residences where more tha~ 2 rooms are available for rent,
except for municipal hydrants, large users, or where use requires
the installation of a meter. The charge indicated covers the first
outlet or fixture in each unit. Additional fixtures are to be
charged at the specified rate thereof.

(6) For hose tap servi~e connections where the lot is vacant,
and the ser'vice through wh~uh the water is delivered is three-fourths
(3/4th) of an inch or smaller, and the fixture or outlet, whether
one or more, is suitable for hose connection only, the rate or
charge on a flat rate basis, shall be as follows:

Irrigation Water
Thirty cents (30) per front or street foot per irrigation season
for each one hundred twenty-five (125) feet or less of depth.
The season for irrigation water purposes shall be deemed June, July
and August, annually, and the Manager shall add to the bills ren-
dered to all consumers to which this rate or charge is applicable,
one-third (1/3rd) of the season charge on each of the bills rendered
July 1, August 1, and September 1, annually.

Section 2: Section 3-3-9 of Chapter 3, Title III, of the
official Code of the City of Aspen, colorado, is hereby amended to
read as follows:
TAP CHARGES:
3-3-9 Ail water users who shall tap the water mains and lines of
the Aspen Water-Works shall pay a tap charge, above all other fees,
based upon the size of the tap to be made, and the following fees
are in addition to any applicable capital repayment fees which are

Section 3: Because of the matters and things hereinabove
set forth, the C~ty Council of the city of Aspen, Colorado, hereby
finds, determines and declares that an emergency exists, and that
this ordinance is necessary for the immediate preservation of the

introducted, read in full, and passed on first
reading at a regular meeting of the City Council of the
City of Aspen on November 7 ,1966., and publish-
ed in the tspen Times a weekly newspaper of general circul-
ation, published in the City of Aspen, Colorado, in its
issue of November 10 .,1966, and was finally adopted
and approved at a regular meeting of the City Council on
November 21 ,196 6 , and ordered published as
Ordinance No. 34 , Series 196 6 , of said City, as
provided by law.
