AN ORDINANCE PROVIDING FOR REGISTRATION OF EMPLOYEES IN
OCCUPATIONS AND INDUSTRIES CRITICAL TO THE ECONOMY OF THE
CITY OF ASPEN, COLORADO, AND VICINITY, ~-'D_- _'2_-C'_-_RiL'-G-.~.~.'
WHEREAS, the economy of the City of Aspen, Colorado,
and the immediate surrounding areas, is, during the summer
months, dependent in large part upon its cultural attractions,
furnished, in part, by the Aspen Institute for Humanistic
Studies, including its executive program, International Design
Conferences, Film Conferences, Symposia and institutes on
cultural, humanistic, economic and philosophical subjects, and,
in part, by the Music Associates of Aspen in their annual music
school; and
WHEREAS, the economy of the City of Aspen, Colorado,
and the immediate surrounding areas, is, during the winter months,
dependent in large part upon the sports of skiing, skating and
hunting; and
W/4EREAS, during appropriate seasons great numbers of
people visit Aspen, Colorado, for varying periods of time; and
WHEREAS, employment possibilities in Aspen vary greatly
with the seasonal influx of visitors and tourists; and
WHEREAS, because of the large numbers of visitors and
tourists, a great many lodges, ~tels, hotels, rooming facilities,
cafes, dining rooms, lounges and bars are located in the City of
Aspen, Colorado, and
WHEREAS, because of these attractions and including
the large though seasonal employment possibilities, persons
seeking employment in many businesses and industries of Aspen
dependent upon the visitor and tourist business, come to Aspen
seeking employment, and
WHEREAS, the turnover of employees is large, and the
opportunities of knowing the employees are few; and
WHEREAS, the incident of crime in and about the City
of Aspen, Colorado has drastically increased due, largely, to
the drastic increase in persons c~ming to Aspen seeking
employment in businesses and industries dependent upon the
tourist and visitor trade; and
WHEREAS, without compulsory registration of employees
in such trades and businesses, the identity of persons committing
crimes is often unknown; and
WHEREAS, this Ordinance is necessary for the health,
safety, morals, good order and general welfare of the inhabitants
and the citizens of Aspen, Colorado, and vicinity, and is a
police measure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ASPEN, COLORADO:
Section 1: This ordinance shall be known as the
"Compulsory Registration Ordinance of Employees in Occupations
and Industries Critical to the Economy of the City of Aspen,
Colorado," and in this Ordinance the following definitions
shall control:
"Business" shall mean all motels, hotels, lodges, inns,
rooming houses, dormitories, restaurants, bars, lounges, ski
lifts, skating rinks, bowling alleys, employing one or more
persons, within the City of Aspen, Colorado.
"Employee" shall mean any person receiving remuneratiOn,
either directly or indirectly, for services rendered to any of
the above enumerated businesses while in the employ thereof,
notwithstanding that said person may be considered self-employed
for tax or other purposes.

any such person from the definition of the term "employee", and
shall relieve such person from further compliance herewith, and
shall relieve any employer of compliance herewith with regard to
such person.
"Department' shall mean the Police Department of
the City of Aspen, Colorado.
"Clerk' shall mean the City Clerk or Deputy City
Clerk of the City of Aspen, Colorado.
Section 2: It shall be unlawful for any person to
hereafter accept employment in any business enumerated in Section
1 hereof, unless such person shall first have registered with the
Department as hereinafter provided, and shall have received a
registration card showing such registration and bearing the
signature of the Clerk and the seal of the City of Aspen, Colorado.
Section 3: It shall be unlawful for any employer at
any business enumerated in Section 1 hereof to hereafter employ
any person required to register with the Department by the terms
of this ordinance, unless such person shall have so registered
with the Department as hereinafter provided.
Section 4: All employees required to register with the
Department by the terms of this ordinance and who accept
employment in any business enumerated in Section 1 hereof shall,
within five (5) days from the date of accepting such employment,
such date and place of employment to the Department.

in Section 1 hereof shall report to the Department the names
and registration card numbers of all persons employed by them
from the date of the employment of each

for and accept employment at any of the herein enumerated businesses
in the City of Aspen, Colorado.
Section 7: On or after the effective date of this
ordinance all employees of all businesses enumerated in Section
1 hereof, and all persons seeking employment with any of said
businesses, shall report to and register with the Department
as follows:
(a) The employee shall make sworn application for
such registration on forms to be furnished by said Department.
(b) The Department shall, on such application form,
obtain the following from the applicant:
1. Full name and sex;
2. Full physical description;
3. Date and place of birth;
4. Residence or domicile;
5. Length of time in Aspen, Colorado, and proposed
length of stay;
6. Employment history of past five years;
7. Criminal history, if any; and
8. Place of employment in Aspen (to be supplied by
applicant after employment is secured)

(c) The Department shall photograph and take the
thumb and fingerprints of applicant;
(d) The applicant shall pay a fee of $2.00 to the
Clerk for issuance of a registration card;
(e) The Clerk, upon request of the Department, shall
issue to the applicant, upon payment of the fee as aforesaid,
a numbered registration card and receipt for fee paid containing
the name, age and physical description of the applicant and
the date of the issuance.
(f) The Clerk shall deliver to the Department a
duplicate copy of each registration card so issued and the
Department shall index and file for at least 10 years all such
registration cards.
Section 8: Application to the Department as aforesaid
for a registration card shall be deemed as consent by the
applicant to have his photograph and fingerprints forwarded to
the Federal Bureau of Investigation, or any other such investigation
agency, with a request for information as to the previous criminal
record of such applicant. Any information received as aforesaid,
however, shall be treated as confidential and shall only be made
accessible to the Mayor and City Council of the City of Aspen,
Colorado, the applicant's employer and law enforcement agencies.
Section 9: Any person guilty of any act herein declared
unlawful, or any person who fails to do any act herein
affirmatively required to be done by such person, shall, upon
conviction thereof, be punished by a fine not exceeding $300.00
or by imprisonment not exceeding 90 days.
Section 10: Administration of this ordinance is
hereby vested in the Police Department of the City of Aspen,
Colorado, which shall prescribe forms andreasonable rules and
regulations in conformity with this ordiance for the adminis-
tration and enforcement hereof.
